689. Examined To all Christian People to whom these presents Shall come I Meriam Richardson widow and Executrix of Samuel Richardson of Frederick County send Greeting Whereas John Penn of Ann arundel County Planter did by Indenture bearing date on or about the eighteen day of October in the Year of our Lord Seventeen hundred and fifty four for and in Consideration of the sum of Forty eight pounds nine Shilling and five pence to him then in hand paid by the said Samuel Richardson Convey make over and Assure to the said Samuel Richardson and his heirs all that Tract or Parcell of Land called Hopes Lott lying in Baltimore County upon hunting ridge containing two hundred Acres of Land more or Less with the proviso and on this condition nevertheless That if the said ^John^ Penn his heirs Executors and Administrators or any of them Should well and truly pay or cause to be paid unto the said Samuel Richardson his Executors Administrators or any of them the said Sum of Forty eight pounds nine Shillings & five pence with legall interest from the date of said Indenture and also the Charges of drawing and recording thereof Then the aforesaid Indenture Should be void as by the aforesaid Indenture inrolled and recorded in the Provincial Court land records Liber EI N.o 12 folio 500 Refference being thereto had will more fully and at Large appear Now know Ye That the aforesaid John Penn paid to M.r Samuel Richardson in his lifetime all the aforesaid Sum of Money and interest thereon due except the Sum of thirteen pounds three Shillings Current Money which he paid unto me the aforesaid Miriam Richardson Executrix of the said Samuel Richardson on the Tenth day of this instant October which being all that was justly due or owing according to the aforesaid Indenture all the true Intent and meaning of the proviso therein I do therefore hereby release unto the said John Penn all the aforesaid parcell of Land called Hopes Lott with all and singular its Appurtenances to him the said John Penn and his heirs for ever and I will for me and my Heirs warrant and defend the said Land and Appurtenances to him the said John Penn and his Heirs against the Claim of the heirs of |
