568 him the s.d Jonathan Birch his heires & Assignes & of From and by any other Person or Persons Claiming by from or under him them or any of them and it is Further Agreed Between the Parties af.d That if Either of them should be Legally ousted or Evicted of the part or parcell of Land hereby in Exchange that then the s.d Party so Legally ousted or Evicted shall Re enter on his former part or parcell of Land and be Therein Vested in Fee Simple In as full and Absolute A manner as if the Exchange herein had never Been made In Witness whereof the s.d Mathew Eversfield & Jonathan Birch have hereunto set their Hands & Seals the Day and Year above written Signed Sealed & Delivered Matt Eversfield Seale In presence of us Nath.l Magruder Jonathan Burch Seal Tho.s Addison Jun.r On the Back of the Aforegoing deed was thus Written Viz.t Maryland Prince Georges County fs May the Fifteenth 1765 Came before us two of his Lordships Justices of the Peace for the s.d County Mathew Eversfield & Jonathan Birch and Elizabeth his wife and acknowledged the within deed respectively to Be their act and the Exchange of the within Parts or Parcells of Land with the Appurtenances thereto Respectively appertaining according to the Limits Courses & Distances within mentioned to be the mutual Estates of the within mentiond Parties their respective heires and Assigns for ever According to the Tenor & Express words of the within Deed and the s.d Elizabeth wife afs.d Jonathan Birch being by us privately Examined out of the Hearing of her s.d Husband did Declare That She willingly & freely made the afores.d acknowledgement of the within deed & her Absolute Relinquishment of her Right of Dower to the part or parcell of Land w.th its Respective Appurtenances therein Exchanged and that the right Thereof be in the within mentioned Mathew Eversfield his heires & Assignes for Ever without being Induced thereto by Force or Threats of or Ill Usage by her Husband or Fear of his Displeasure Taken and acknowledged before us the Day and Year first above written Nath.l Magruder Tho.s Addison Jun.r 1765 May 17.th Reced Fourteen pence Ster.g for an Alienation fine on the within Twenty seven & a half acre of Land by order of Coll Edward Lloyd Agent for the Right Honble the Lord propry of Mary.d J Hepburn Recorded 29.th June 1765 13 1/4 sides |
