51) is hereby Acknowledged and for divers other good causes and considerations of him the said Richard Hall in this behalf moving ^hath Granted Bargained Sold Released and Confirmed and by these presents doth Grant Bargain Sell Release & Confirm unto the said Thomas Jones his Heirs & Assigns for ever^ All that Tract or Parcel of Plantable Land called Halls Adventure Situate lying and being on the East side of Chesepeak Bay on the North side of a Gutt on the Westermost side of a Branch small Creek called Charles's Creek thence with a line drawn North North West two hundred and thirty Perches to a marked Gum standing in a Swamp thence with a line drawn North East two hundred Perches to a marked Pine thence with a line drawn North eighty one Degrees Easterly ninety Perches to a marked Red Oak a corner Tree of a Parcel of Land formerly Surveyed for Philip Berry thence with a line drawn South eighty Perches thence with a line drawn South by West half a Point Westerly sixty two Perches to the head of the afsd Creek and from thence bounded down the said Creek called Charles's Creek by the said Creek to the first Bounder containing and laid out for two hundred & fifty Acres more or less together with all Buildings Orchards Gardens, Fences, Improvements Profits, Priviledges, Hereditaments and Appurtenances to the same belonging or in any manner appertaining And also the Reversion and Reversions Remainder and Remainders of the said Premisses with the Appurtenances and all the Estate Right Title and Interest Claim Property and Demand whatsoever of him the said Richard Hall of in to or out of the said hereby Bargained Premisses with the Appurtenances To have and to hold the said Messuage Lands and Premisses above mentioned and every part thereof with the appurtenances unto the said Thomas Jones his Heirs and Assigns forever to the Intent and Purpose only that the said Thomas Jones shall and may become perfect Tenant of the Freehold of the said Messuage Lands and Premisses and shall and may stand and be Seized thereof untill a good and perfect Common Recovery with Double Vouchers over may be duly had Suffered and Executed of the said Messuage Lands and Premisses according to the Usual Course of common Recoverys for the Assurance of Lands and Tenements in such Cases used and accustomed And thereupon it is Covenanted Concluded and Agreed by and between all the partys to these Presents for themselves their and every of their Heirs by these Presents in manner and form following that is to say That the said Thomas Jones shall and will before the end of the next Provincial Court to be held in and for the Province of Maryland Permit and suffer the said Joshua Hall to sue forth and Prosecute against him the said Thomas Jones one Writ of Entry Sur Disseisin en le Post returnable before his Lordship the Right Honble the Lord Proprietary his Justices of the said Provincial Court at the City of Annapolis thereby demanding against the said Thomas Jones the said Messuage Tenement Lands Hereditaments and Premisses herein before mentioned by such Name and Names Number of Acres Quantitys Qualities Terms and Descriptions in the said Writ to be contained and in such manner and form as by Council learned in the Law shall be Advised unto and upon which Writ of Entry so to be Prosecuted and sued forth the said Thomas Jones shall appear Gratis in his own Proper Person or by his Attorney or Attorneys Lawfully Authorized and shall and will Vouch or call to Warrant the same Premisses the said Richard Hall who shall appear Gratis in his own Proper Person or by his Attorney or Attorneys Lawfully Authorized and shall and will enter into the said Warranty and Vouch over to Warrant the same Premisses the Common Vouchee who shall appear and enter into the said Warranty and after Imparlance make default and depart in Contempt of the Court so that Judgment may be thereupon had and given for the said Joshua Hall to recover the said Messuage or Tenement Lands Hereditaments and Premisses against the said Thomas Jones and for the said Thomas Jones to recover in Value against the said Richard Hall and for the said Richard Hall to recover in Value against the Common Vouchee to the end one perfect common Recovery with double Vouchers may be thereupon had and suffered and all and every other thing and things be done and perfected needfull and Convenient for the having and suffering the same Recovery according to the Course of Common Recoverys in such Cases used And the same Recovery is also to be Executed by one Writ of Habere facias Seisinam accordingly And it is hereby further Covenanted Concluded and Agreed by and between all the said Parties to these Presents for themselves and every of them their and every of their Heirs that the said Recovery so as afd or in any other manner to be had and suffered of the said Messuage Tenement Lands Hereditaments and Premisses above mentioned shall be and enure and shall be deemed Adjudged and taken and is meant and Intended and by all the said partys to these Presents is hereby Declared to be and Enure and the said Joshua Hall and his Heirs from and immediately after ^the^ Suffering the same shall stand and be Seized of all and Singular the said Messuage Tenement Lands and Hereditaments above mentioned and every part and parcel thereof with the (Appurtenances) |
