329) Prince Georges County fs.t 18.th December 1752 Then Came before me us the subscribers two of his Lordships Justices of the County aforesaid the within named Henry Hall and Elizabeth his Wife and Acknowledged the within Instrument of Writing to be their Act and Deed and that the Land and Premisses therein specifyed were the Right and Estate of the within named Benedict Calvert his heirs and Assigns According to the true Intent and meaning of the said Deed and the said Elizabeth being by us Examined a Part from and out of the hearing of her said husband did respect as above and that she made this acknowledgment of her own free will and Concent without any Compulsion or threats from her said Husband or fear of his Displeasure Mord.a Jacob Rob.t Tyler December the 26.th 1752 Received of Benedict Calvert Esq.r Two shillings and two Pence half Penny Sterling for his Lordships use (it being the Alienation fine on the within Mentioned One hundred and ten Acres of Land) by virtue of a Commission from Benjamin Tasker Esq.r his said Lordships Agent and Receiver General Rich.d Dorsey Recorded Decemb.r 26.th 1752 8 Ex.d This Indenture made the twenty Ninth Day of August in the Year of our Lord Seventeen hundred and fifty two Between Doctor Andrew Scott of Baltimore County of the One Part and Doctor David Ross of Prince Georges County of the other part Whereas the aforesaid Andrew Scott is now at the time of sealing and Delivery of these Presents seised in Fee Simple of and in two third Parts of a Tract or Parcell of Land called Sewall's Relief Containing or Laid out for thirty Acres scituate Lying and being in Baltimore County aforesaid And Whereas the aforesaid Andrew Scott is also Possessed of and entituled unto a Lease or Demise bearing Date on or about the thirtyeth day of August in the Year of our Lord Seventeen hundred and fifty and made between a Certain Philip Jones junior of Baltimore County aforesaid of the one Part and the aforesaid Andrew Scott party to these Presents of the other Part of for in and to the other third Part of the aforesaid Tract or Parcell Land Called Sewall's Relief for and during the Term of five Years as by the said Indenture of Lease Relation being thereunto had may Appear And Whereas the aforesaid Andrew Scott hath Obtained out of his Lordships Land Office in this Province a special Warranty of Resurvey of the aforesaid Tract of Land Called Sewall's Relief with Liberty of Ading thereto Contiguous Vacancy upon which Warrant a Resurvey have been made and a Certificate thereof is now Returned unto the said Land Office Containing and Including within the lines of such Resurvey the Quantity of One thousand Nine hundred and thirteen Acres of Land against a Patents Issuing upon which Certificate of Resurvey to the aforesaid Andrew Scott there is now Depending undetermined a Caveat in the said Land Office as by the said Land Office Recourse being thereto had may Appear And Whereas by Writing under hand and seal bearing Date on or about the sixteenth day of May now last past and made between the afs.d Andrew Scott of the One Part and the Honourable Daniel Dulany Esquire of Annapolis of the other Part it is mutually agreed by and between the said Andrew Scott and Daniel Dulany that the said Daniel Dulany shall Immediately on a Diseisin of the aforesaid Caveat entred as aforesaid in the said Land Office against a Patents Issuing on the aforesaid Resurvey if the said Caveat should be Discharged pay the sum of Ninety Eight Pounds and five shillings sterling to his Lordships Agent for the Caution Money and Improvements of and upon the said Land in Consideration of which sum and of fifty Pounds Current Money theretofore adwanced by the said Daniel Dulany and of fifty Pounds like Money Adwanced by a Certain James Wardrop his Lordships Agent for the Caution Money and Improvements of and upon the said Land in Consideration of which sum and of fifty Pounds Current Money theretofore Adwanced by the said Daniel Dulany and of fifty Pounds like Money Adwanced by a Certain James Wardrop Merchant in Ma^r^lborough he the said Andrew Scott should Assign ^unto^ to the said Daniel Dulany |
