357) The next Provincial Court whereby the said John Dorsey shall and may Demand against the said Benj.a Howard all that part of a Tract ^or parcell^ of Land with the Appurtenances called Ropers Increase lying in Baltimore ^County^ Begining at a White Oak standing at the end of one hundred Perches in the West line of the Original Survey of the said Tract of Land called Ropers Increase and Runing West two hundred Perches ^then south one hundred & sixty perches then East Two hundred Pches then North One hundred and sixty perches^ to the said Bounded White Oak Containing Two hundred Acres of Land by such Name or Names Quantity or Quantities of Acres as shall be thought fit and Requisite to which Writ or Writs the said Benjamin ^Howard^ shall appear in proper person and Vouch Over to Warranty the Common Vouchee and the Common Vouchee shall appear and Imparle and afterw.ds shall make Default whereby one or more Recovery or Recoveries Judgment or Judgments May be had and given for the said John Dorsey for Recovery of the said Land and Premisses as af.d against the said Benjamin Howard and for the said Benjamin Howard to Recovery in Value against the Common Vouchee according to the form of Common Recoveries in such Cases used and it is further Covenanted and ^Granted &^ agreed by and between the parties to these Presents and the true Intent and meaning of the parties to these Presents in that from and immediately after the said Common Recovery or Recoveries shall be had and Prosecuted as af.d of the Lands & Premes the said Recovery or Recoveries shall be and enure and are hereby declared to be Intended to be & enure that the said John Dorsey and every other Person (That) |
