249) Cooper shall think fitt and the Profits Proceed and Interest of the said sum of One hundred Pounds shall from time to time during the Joynt lives of them the said William and Grace be paid to the said Grace or to such Person or Persons as she shall for that Purpose nominate and appoint And in Case the said Grace should Survive and outlive the said William then the said Sum of One hundred Pounds to be the only Proper Interest and benefit and Advantage of the said Grace and not to be subject to the Disposition Countroul or Interest of him the said William & to be free and Clear from all Debts and Incumbrances made or Contracted by him but in Case the said Grace should Dye before the said William her intended Husband then the said Principall Sum of One hundred Pounds to be at the Disposition of the said Grace in Such Manner & to such Uses and Purposes as she the said Grace by her last Will and Testament in Writing or by any other Writing by her Executed in the Presence of two or more Credible Witnesses shall for that purpose limitt devise direct or appoint & to & for no other use or intent or purpose whatsoever It being the true Intent and Meaning of both the Parties to these Presents that the said Sum of One hundred Pounds shall be for the Sole Use and benefitt of the said Grace & such Person or Persons as she shall limit and appoint the same to In Witness whereof the Parties to these Presents have Interchangeably set their hands and seals the Day & Year above written Sealed and Delivered W.m W Lapeer Seal Mark in the presence of Grace Cooper Seal Sam.l Hunter On the back of the aforegoing Deed was thus Rich.d Burdus Endorst (Viz.t) July 1.st 1741 Then Came before Josh Hopkinson me one of his Lordships Justices of the Provincial Court of the Province of Maryland Richard Burdus and Joshua Hopkinson two of the subscribing Evidences to the within Deed & Made Oath on the Holy Evangelist of Almighty God that on the fifteenth Day of May last past (to the best of their knowledge they severally said the within named William Lapeer & Grace Cooper Sign Seal and Deliver in due form of Law the same Deed as their Several Acts and Deeds and that the other subscribing Witness was present at the Executing thereof and Subscribed his Name with these Deponents as Evidences thereto recorded July 1.st 1741 Robert Gordon 6 |
