(66) Sold and by these Presents Do bargain and sell unto the said Charles Carroll all that Tract or parcell of Land Called Mill Haven Lying in Baltemore County afd on the North side of Patapsco River heretofore to wit on the Twentieth day of May in the year of Our Lord One thousand Six Hundred and Ninety five Granted in Due form of Law by the Right Hon.ble Charles then Lord propry of Maryland to John Merser Late of Ann Arundell County Planter Deceased Begining at a bounded white oak standing near the Middle Branch of the said River running south West and by West One hundred and Twenty perches to a Marked white Oak then running West North West One Hundred & sixty perches to a Marked Red Oake then running North East and by East One Hundred and Twenty Perches then running along the Branch to the first Bounded white Oak Containing One hundred acres as by the Said Grant remaining on Record in the Land Office may appear together with all Buildings Improvements profitts profitts & advantages and appurtenances whatsoever thereunto or unto any part thereof belonging or appertaining To have and to hold to him y.e said Charles Carroll his Heirs and Assigns for ever to and their own use and to no other use or purpose whatsoever And the said George Buchannan for himselfe and the said Eliner & their Heirs Doth hereby Covenant and Agree to & with the said Charles Carroll his Heirs and assigns that they the said George & Elinor are or that one of them is & standeth seized of an Estate of Inheritance in Fee Simple or Fee Tail of & in the said Land and Premisses with the appurtenances and that the same is Free & Clear from all incumberances for or by reason of any act or thing by them the said George ^and Elinor & either of them had done or committed and the said George^ Buchannan for himself and the said Elizabeth and their Heirs Doth further Covenant and Agree to and with the said Charles Carroll his Heirs and Assignes that they the said George and Elinor or their Heirs shall and will at any time hereafter at the proper Cost and Charge in the Law of him the Said Charles Carroll his Heirs or assignes & at his or their Reasonable request by fine or fines with proclamations in due form of Law to be Levied Recovery or Recoveries to be had pursued or suffered according to the order and the Course of Common Recoveries Deed or Deeds Inrolled or otherwise or such other sufficient Conveyance or assureance in the Law as the said Charles Carroll his Heirs or assignes or his or their Councill Learned in the Law shall Devise Advise or require for the better assurance and more firm Conveyance of the said Land Premisses to the said Charles Carroll his heirs and assignes for Ever Will Convey Do Execute and Perform In Witness whereof the Said George Buchannan & Elinor his Wife to these Presents have sett their hands & seales the day and year first above Written Sealed and Delivered Geor Buchannan seale In the presence of us the Words (White) first interlined Between the Elinor Buchannan seale tenth & eleventh Lyne Rich.d Gist Charles Hissey (On) |
