(h) Any person operating a fireworks plant in this State for
which a license has been denied, suspended or revoked is guilty of
a misdemeanor and upon conviction shall be fined not more than
$2,000.00 or imprisoned for not more than two years, or both.

20.

(a)    All fireworks plants shall be completely surrounded by a
substantial fence having a minimum height of six feet including not
less than three strands of barbed wire. All buildings, except office
buildings in which no processing or storage is permitted, must be
located within the fence. All openings in the fence shall be equipped
with suitable gates which shall be kept securely locked at all times,
except when in actual use; except that the main gate of the plant
may be left open during the regular hours of plant operation while
in plain view of and under observation by authorized responsible
employees or guards. Conspicuous signs indicating: "WARNING

NO SMOKING—NO TRESPASSING" shall be posted along the
plant fence at intervals not to exceed 500 feet.

(b)    At least one competent watchman shall be on duty at all
times that any explosive composition is located with
WITHIN a fire-
works plant. This watchman shall not sleep while on duty and shall
make regular patrols of the entire plant when the plant is not in
operation.

(c)    No fireworks plant shall be located so that any mixing build-
ing, or storage building therein is nearer than two hundred (200)
feet to any inhabited building, or any highway or any railroad; or
nearer than one thousand (1000) feet to any school, church, hospital,
or other place of public assembly, or gasoline or fuel oil storage
building, or service station. All buildings containing hazardous
mixes or items within a fireworks plant shall not be closer to the
plant property line than as
permitted by regulations promulgated
by the State Fire Prevention Commission. Distances specified or
provided for in this section shall not be reduced by the presence of
barricades or earth covers except where candle and rocket press
buildings are of an approved fire resistant construction and are bar-
ricaded and meet the requirements of the State Fire Prevention
Commission, they may be no less than fifty (50) feet from other
finishing and assembling buildings.

(d)    No finishing and assembling building shall be less than
seventy-five (75) feet from any other finishing and assembling
building, or less than two hundred (200) feet from any storage build-
ing devoted principally to the storage of finished fireworks, except
sparklers.

(e)    All fireworks plants in this State, regardless of when con-
structed, shall conform to the requirements of this subtitle before
being granted a new license or renewal of a currently effective
license.

21.

Buildings in fireworks plants shall be constructed and equipped
