and Punishment," subheading "Department of Correctional Serv-
ices," sub-subheading "Prisoners," to follow immediately after
Section 700C thereof, to provide that upon the recommendation
of the Warden or Superintendent of a State penal or reformatory-
institution and the concurrence of the Commissioner of Correc-
tion, prisoners may be authorized to leave a State penal or re-
formatory institution for the purpose of special leave; and to
specify some of the purposes for special leave.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 700D be and it is hereby added to Article 27
of the Annotated Code of Maryland (1967 Replacement Volume,
1969 Supplement), title "Crimes and Punishments," subtitle "Places
of Reformation and Punishment," subheading "Department of Cor-
rectional Services," sub-subheading "Prisoners," to follow immedi-
ately after Section 700C thereof, to read as follows:

700D                           

Upon the recommendation of treatment staff, with the approval
of the Warden or Superintendent of any State penal or reformatory
institution under his jurisdiction, the Commissioner of Correction
may authorize special leave to an inmate or inmates to leave an in-
stitution for participation in special community or other meri-
torious programs or activities deemed beneficial to the inmate
,
AND NOT DETRIMENTAL TO THE PUBLIC, or inmates
by both the Warden or Superintendent and the Commissioner
of Correction and which in their judgment would contribute to the
resocialization
REHABILITATION process of the respective inmate
or inmates. To be considered for this special leave the inmate or in-
mates shall be eligible solely upon the concurrence of the Warden
or Superintendent and the Commissioner of Corrections that positive
attitudinal and growth patterns are being established.
ALL SPECIAL
LEAVES MUST BE ISSUED IN WRITING AND MUST BE
SIGNED BY BOTH THE WARDEN OR SUPERINTENDENT
AND BY THE COMMISSIONER OF CORRECTIONS, AND THIS
AUTHORITY MAY NOT BE DELEGATED. ALL SUCH ORDERS
MUST BE KEPT ON FILE IN THE DEPARTMENT. Suggested
but not limiting
justification for special leave would
SPECIAL
LEAVE MAY ONLY be for the purpose of:

(a)    attending educational programs.

(b)    improving job skills.

(c)    attending TRADE licensing examinations.

(d)    being interviewed for employment.

(e) participating in drug abuse, delinquency and crime preven-
tion programs.

(f) (E) participating as a volunteer for a non-profit organiza-
tion or governmental agency in an activity serving the general public.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
