rigs known as [a] sneak boats, customarily used or intended to
be used in connection with wild waterfowl hunting, or a flat bottom
bateau or boat with bush or canvas blinds (commonly known as a
bushwacking outfit) which shall be without power, except oars, and
may be used in shooting or gunning over decoys; provided that an
outboard motor may be used on a sneak boat to make the run back to
"john goose" or cabin boat after the scull has been made and the
shots taken but no shots shall be fired while the motor is attached,
except as permitted by Federal laws or regulations. No boat
used as a sneak boat or for bushwacking shall be of
dimensions less than sixteen (16) feet in length nor less
than [twenty (20)] sixteen (16) inches at the lowest point in
height. [Hunting from a sneak boat or bushwack outfit shall be
legal on the Susquehanna Flats in Harford or Cecil counties during
the legal open season.

It will be unlawful for a nonresident to shoot from a bushwacking
or sneak boat on the Susquehanna Flats unless the legal holder or
resident co-owner of the license accompanies the rig. In case of
resident co-ownership of the rig the license may be issued in two
names.]

[167.] 168.

(a)    It shall be unlawful at any time, either in the day or night,
to hunt, pursue, shoot, or kill any wild waterfowl in or over the Flats
from any craft of any kind or from a blind erected on or off the
island known as the Battery except [a gunning rig as defined by law
and from a stationary blind,] by the means as defined in Section
167,
and then only after the same has been licensed as provided by
law. If any person or persons shall have in his or their possession a
boat of less dimensions than provided by law on the Susquehanna
Flats between the first day of November and the first day of Febru-
ary following, this fact shall be prima facie evidence of a violation
of this subheading; provided, however, boats of smaller dimensions
may be used in stationary booby or brush blinds as provided by law.

(b)    It shall be unlawful to shoot a gun on the Flats at night-
time. The word "nighttime" shall be construed to mean the time
as set forth annually by regulation adopted by the Secretary of the
Interior, [when migratory birds may be taken during the lawful
open season.]

[168.] 169.

(a) It shall be unlawful for a gunning rig or any craft connected
therewith, whether said rig be anchored or otherwise, to be on the
Flats before 3:15 A.M. local standard time on any gunning day.

Any gunning rig so found by any officer empowered with the
enforcement of the game and fish laws of this State shall be at once
seized and removed from the Flats and not allowed to return until
the case is heard and determined, and shall be subjected to such
further penalties as may be prescribed by this subheading or other
laws of the State of Maryland.

It shall be unlawful to cross the line above referred to for the pur-
pose of selecting a set for a gunning rig in any boat other than one
carrying or towing the entire gunning rig; and it shall be unlawful
for any other boat or device to cross said line.
