(b)    The commissioner may refer to this board for an advisory
opinion, the cases of all persons applying for a driver's license, or of
all persons whose licenses have been suspended or revoked, if he has
good cause to believe that the operation of a vehicle on a highway
by these persons would be inimical to public safety and welfare be-
cause of an existing or suspected mental or physical disability.

(c)    The board shall meet at the pleasure of the commissioner.

(d)    Each member shall receive compensation for each meet-
ing he attends, to be paid out of funds appropriated to the depart-
ment.

(e)    The records of the Medical Advisory Board shall be main-
tained as confidential and may only be revealed upon order of the
court.

§ 2-306. Merit System provisions.

All employees now employed by the department under the Mary-
land Merit System shall be retained under the Maryland Merit Sys-
tem, and all new employees shall also be employed under the merit
system unless otherwise provided by law.

§ 2-307. Powers and duties of commissioner.

(a)    The commissioner has the power and is charged with the
duty of observing, administering, and enforcing the provisions of
this article relating to the department.

(b)    The commissioner may adopt and enforce rules and regula-
tions as necessary to carry out the provisions of this article as they
relate to the department and of any other laws the enforcement and
administration of which are vested in the department.

(c)    The commissioner shall adopt an official seal for the use of
the department.

(d)    The commissioner shall file with the Governor on the last
day of September in each and every year, an account of the receipts
and disbursements of his office, as provided for in this article. He
shall transmit monthly a statement of the receipts and disbursements
of his office for the preceding month and all monies coming into
his hands under the provisions of this article to the State Treasurer,
to be used as provided elsewhere in this article, and shall receive
a receipt therefor.

(e)    In case of the absence of the commissioner or his inability,
from any cause, to perform the duties of his office the Deputy Com-
missioner shall exercise all the powers and perform all the duties of
the commissioner during his absence or inability.

§ 2-308. Office of department.

The commissioner shall maintain one or more offices in such
places in the State as he deems necessary properly to carry out the
powers and duties vested in the department. It shall be kept open
daily, excepting Saturdays, Sundays, and holidays, during hours as
the Governor prescribes.

§ 2-309. Commissioner to prescribe forms.

The commissioner shall prescribe and provide suitable forms of
applications, certificates of title, registration cards, drivers' licenses,
