the person who transported, sold, offered or exposed the sod for
sale, of any violation.
(2) FOLLOWING A PUBLIC HEARING AND DUE PUBLIC
NOTICE, To TO prescribe rules and regulations governing the
methods of labeling, inspecting, sampling, analyzing, testing, DE-
FINING PROHIBITIVE AND RESTRICTIVE NOXIOUS WEEDS,
and examining sod, plugs or sprigs, and the tolerances to be fol-
lowed in the administration of this subtitle, and such other rules and
regulations as may be necessary except that the production, process-
ing and labeling requirements of this subtitle shall not apply to the
"breeder" and "foundation" generations of turf grass variety devel-
oped and released by the Maryland Agriculture Experiment Station.
(3) To determine which noxious weeds materially affect the
quality of the sod; which adversely affect the health of inidividuals
of livestock, and which constitute a hazard or threat to existing land
usage, and based upon such findings, prescribe, by regulations, which
woods shall be prohibited and which shall be restricted.
(4) To direct the sod certification program in the state.
(B) For the purpose of carrying out the provisions of this sub-
title, the State Board of Agriculture is authorized—
(1) To enter upon any public or private premises and vehicle
during regular business hours and to stop, whenever necessary to
insure compliance, any public or private sod carrying vehicle.
(2) To issue and enforce a written or printed "Stop Sale" order
to the owner or custodian of any lot of sod in violation of any of the
provisions of this subtitle which shall prohibit further sale of such
sod until it is in compliance with the law.
(3) To establish and maintain or make provisions for laboratory
and field testing of sod, to employ qualified persons, and to incur such
expenses as may be necessary to comply with these provisions.
(4) To make or provide for making purity analyses, weed exam-
inations, tests and examinations of fields for farmers and dealers on
request; AND FOLLOWING A PUBLIC HEARING AND DUE
PUBLIC NOTICE to prescribe rules and regulations governing such
analyses, tests, and examinations,' and to fix and collect charges for
the analyses, tests, and examinations made.
(5) To publish the results of the analyses, tests, and examina-
tions made under the provisions of this subtitle.
(6) The State Board of Agriculture is authorized to apply to the
Circuit Court of any County or Baltimore City to grant a temporary
or permanent injunction restraining any person from violating or
continuing to violate any of the provisions of this subtitle or any
regulation promulgated thereunder notwithstanding the e |
