Said Peter in manner afd being indebted, did in his lifetime assume on himself & to the sd Peter faithfully promise that he the sd William the Same to the sd Peter would well & truely Content & pay Nevertheless the Said William in his lifetime nor the sd Dinah Since the death of ye sd Wm, Admrx of all and Singular the goods Chattels & Credits which were of the sd Wm at the time of his death nor either of them the same to the Said Peter hath not paid to the damage of the sd Peter of 1000 Pounds of tobacco & thereof he brings this Sute &ca. Dent Plegs &ca. {Jno Doe Rich Roe} The Plt having Proved his Declaracon the Originall Writt being returned Non est Inventus, humbly Craved Attachmt agt the goods &ca with Cost which to him was granted giving Security according to Law — Whereupon came the Plt with his Security Ephraim= Wilson & pr Recognizance did acknowledge themselves to be indebted to the Dft the Sum of 1000 pounds of tobacco with Condicon that if ye Absent Dft Came either in Person or by her Attorney & plead in Barr to the Originall that the fd debt is paid or in part that then they will be responsible as the Law in Such Cases requires &ca. Attachmt issued George Layfield Esqrd Plt Michl Turbut & Ja. Murphey Dfts} Somerset County Ss. ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Michael Turbutt & James Murphey Admrs of all & Singular the goods Chattels & Credits of Vincent Loe late of Talbott County Esqr was attached to answer unto George Layfield Esqr Plea of trespass of the Case &ca. – And whereupon the sd George by Sam Worthingon his – Attorney Comes & Saith in the year of or Lord God 1689 at Manokin within the Jurisdiction of this Court a Certain Communication was had & moved betwixt ye sd Vincent & the sd George wherein it was Agreed betwixt both parties , that whereas the sd Vincent had obtained Letters of Admrn to Admr upon the Estate of Samuel Cooper late of this County deceased, which Estate he said was indebted unto him the Sum of nine thousand pounds of tobacco he did Assign over unto ye afd George Layfield for ye just Sum of Sixteen pounds ten shillings Sterling in hand pd by mr Wm Blankensteen of St Maries County ye aforesd Vincent promissing to warrant the Debt to be justly due & that he had legally obtained the letters of Admrn . Now Jane Cooper ye Relict of Samuel Cooper understanding what was Done by the sd Vincent & how he had illegally obtained letters of Admrn to Admr upon the Estate of her deceased husband which of right did belong to her to doe, the sd Jane Relict of the sd Samuel Cooper upon the 3d day of April 1690 proferred a Petion to ye Convention of this Province then Sitting at St. Maries Setting forth her Condition
