CHAPTER 530
(Senate Bill 269)

AN ACT to repeal and re-enact, with amendments, Sections 29 and
32 (a) of Article 89 of the Annotated Code of Maryland (1964
Replacement Volume), title "Department of Labor and Industry,"
subtitle "Occupational Safety," to
include sanitation in places of
employment as a responsibility of the employer and to provide
for the adoption of rules and regulations for prevention of occu-
pational diseases in places of employment.

AN ACT TO REPEAL AND RE-ENACT, WITH AMENDMENTS,
SECTIONS 29, 31 (A), AND 32 (A) OF ARTICLE 89 OF THE
ANNOTATED CODE OF MARYLAND (1964 REPLACEMENT
VOLUME), TITLE "DEPARTMENT OF LABOR AND INDUS-
TRY," SUBTITLE "OCCUPATIONAL SAFETY," TO INCLUDE
HEALTH SANITARY CONDITIONS IN PLACES OF EMPLOY-
MENT AS A RESPONSIBILITY OF THE EMPLOYER; TO
CHANGE THE NAME OF THE OCCUPATIONAL SAFETY
ADVISORY BOARD; TO ADD TWO MEMBERS TO THE
BOARD REPRESENTING THE HEALTH PROFESSIONS; TO
PROVIDE FOR THE APPOINTMENT, QUALIFICATIONS,
AND TENURE OF THE ADDITIONAL BOARD MEMBERS;
AND TO PROVIDE FOR THE ADOPTION OF RULES AND
REGULATIONS FOR THE PREVENTION OF UNHEALTHY
ENVIRONMENTS IN PLACES OF EMPLOYMENT.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 29 , 31 (A) and 32 (a) of Article 89 of the Annotated
Code of Maryland (1964 Replacement Volume), title "Department of
Labor and Industry," subtitle "Occupational Safety," be and they
are hereby repealed and re-enacted, with amendments, to read as
follows:

29.

Every employer shall furnish and maintain employment and a
place of employment which shall be reasonably safe and sanitary
HEALTHFUL SANITARY for employees. Every employer shall
install, maintain and use such methods, processes, devices and safe-
guards, as are reasonably necessary to protect the HEALTH, life
and safety of such employees, and shall do every other thing reason-
ably necessary to render safe and sanitary HEALTHFUL SANI-
TARY such employment and place of employment.

31.

(A) THERE IS HEREBY CREATED WITHIN THE DEPART-
MENT OF LABOR AND INDUSTRY AN OCCUPATIONAL
HEALTH AND SAFETY ADVISORY BOARD (HEREINAFTER
REFERRED TO AS "THE BOARD") CONSISTING OF SEVEN
