the members of the General Assembly within the limited time at
their disposal; and
Whereas, The Constitutional Convention of the State of Mary-
land has included in the proposed new Constitution for the State of
Maryland a provision that the doctrine of sovereign immunity may
not be pleaded as a defense in suits against the State, its instru-
mentalities and its political subdivisions except to the extent and
in the manner as shall be permitted by law law; now, therefore, be it
Resolved by the General Assembly of Maryland, That the Governor
of Maryland is hereby requested to appoint a Commission of ten
members to make a comprehensive study on the extent to which
state and local governments and their officers should be liable in tort
and on how best to insure that funds are available to state and local
governments to meet such claims, and the Commission is requested
to make its report with recommended legislation to the Governor and
the Legislative Council for submission to the General Assembly;
and be it further
Resolved, That the Governor is requested to include on this Com-
mission one member of each House of the General Assembly, two
attorneys admitted to practice in Maryland who are employees of
the State of Maryland or of any county or municipality in Maryland,
two attorneys admitted to practice in Maryland who commonly
represent plaintiffs in tort suits, two employees of insurance com-
panies licensed to do business in Maryland, one certified public ac-
countant, and one faculty member at an accredited college or uni-
versity in the State of Maryland; and be it further
Resolved, That the Governor is requested to provide such funds
as the Commission may need to carry out its duties and to employ
professional staff for the Commission from contingent funds at his
disposal; and be it further
Resolved, That copies of this Resolution be sent to the Governor
of Maryland and to the Presidents of the Maryland, Baltimore City
and each county bar association and to the President of the Junior
Bar Association of Baltimore City.
