such notice shall be accompanied by a copy of the complaint. The
Board shall be authorized to extend the period of filing any of the
documents to accompany the said notice upon proper cause.

155.

(a) The Board shall assign to insurers for investigation and
defense, all default actions described in Section 163 and all actions
against the [Commissioner] Board brought under [Section 167]
Sections 167 through 169 of this Article.

166.

The Treasurer shall not pay any sum from the fund, in com-
pliance with an order made for that purpose, in any case in which
the claim is founded upon a judgment, except a judgment obtained
against the [Commissioner] Board under this subtitle, until the
applicant assigns the judgment to the [Commissioner] Board, and,
thereupon, the [Commissioner] Board shall be deemed to have all
the rights of the judgment creditor under the judgment and shall
be entitled to enforce the same for the full amount thereof with
interest and costs, and if more money is collected upon any such
judgment than the amount paid out of the fund, the [Commissioner]
Board shall pay the balance, after reimbursing the fund, to the
judgment creditor.

167.

(a) When the death of, or personal injury to, any person arises
out of the ownership, maintenance or use of a motor vehicle in
this State on or after June 1, 1959, but the identity of the motor
vehicle and of the operator and owner thereof cannot be ascertained
or it is established that the motor vehicle was, at the time said acci-
dent occurred, in the possession of some person other than the
owner without the owner's consent and that the identity of such
person cannot be ascertained, any qualified person who would have
a cause of action against the operator or owner, or both, in respect
to such death or personal injury for a sum in excess of one hundred
dollars ($100.00), exclusive of interests and costs, or the personal
representative of such person, may, upon notice to the [Commis-
sioner and the] Board, apply to a court of competent jurisdiction for
an order permitting him to bring an action therefor against the
[Commissioner] Board in such court, and the court shall hold a hear-
ing upon such application, and may make an order permitting the
applicant to bring such an action against the [Commissioner] Board,
when the court is satisfied upon the hearing of the application,
that—.

167A.

Any qualified person, who, after June 1, 1964, suffers damages
resulting from bodily injury or death or damage to property caused
by an operator or owner whose whereabouts cannot be ascertained,
and who has instituted a cause of action against the operator or
owner, or both, in respect to such [death or bodily injury] damages
for a sum in excess of one hundred dollars ($100), exclusive of
interests and costs, or the personal representative of such person,
may, upon notice to the [Commissioner and the] Board, apply to
a court of competent jurisdiction for an order permitting him to
