cations for approval of construction involving conversions, altera-
tions, or additions under the provisions of this subtitle and any
amendments thereto. Three (3) members of said advisory board
shall be appointed from a list of names submitted by the Medical and
Chirurgical Faculty of Maryland. ONE MEMBER OF SAID AD-
VISORY BOARD SHALL BE APPOINTED FROM A LIST OF
NAMES SUBMITTED BY THE MARYLAND PHARMACEU-
TICAL ASSOCIATION. Four (4) members of said advisory board
shall be appointed from a list of names submitted by the Hospital
Council of Maryland, Inc., of which [one (1)] two (2) shall be
[superintendent] administrators of [a] Maryland hospitals, [one (1)
shall be a person who has been an owner or operator of a licensed
nursing home within the State of Maryland for a period of not less
than three years prior to the date of his appointment,] one (1) shall
be a trustee of a Maryland hospital and at least one (1) of whom
shall be a member of the Medical and Chirurgical Faculty of Mary-
land engaged in the private practice of medicine. [At least four (4)
members of the advisory board shall be doctors of medicine and
members of the Medical and Chirurgical Faculty of Maryland.] One
(1) member of the advisory Board shall be a person who has been
an owner or administrator of a licensed nursing home within the
State of Maryland for a period of not less than three years immedi-
ately prior to the date of appointment and who shall be appointed
from a list of names submitted by the Maryland Nursing Home
Association, Inc. The members of the said advisory board who are
in office on June 1, [1954] 1964, 1965 shall continue for the balance
of the terms for which they were respectively appointed. [When
the first vacancy on the said board occurs after June 1, 1954, involv-
ing a membership which has theretofore been held by a superintendent
of a Maryland hospital, the Governor shall appoint as a member of
the board a person who has been an owner or operator of a licensed
nursing home as provided hereinabove; such appointment shall be
for a period of five (5) years, and thereafter all of said positions on
the advisory board shall be filled as provided in this section.] All
members of said advisory board shall be citizens and residents of
the State of Maryland for a period of at least one year immediately
prior to appointment; at least two (2) shall be residents of the City
of Baltimore; at least two (2) shall be residents of the counties;
and all members shall serve without compensation. Meetings of
said advisory board may be called by the State Board of Health and
Mental Hygiene or by any three members of the advisory board on
proper notice.

Any person maintaining and operating a hospital or related institu-
tion without a license shall be guilty of a misdemeanor, and upon
conviction thereof shall be liable to a fine of not more than one
hundred dollars ($100.00) for the first offense and not more than
five hundred dollars ($500.00) for each subsequent offense, and each
day such hospital or related institution shall operate after a first con-
viction shall be considered a [second] subsequent offense.

Any person maintaining and operating a [hospital used as a nurs-
ing, convalescent or care home in violation of the minimum standards
promulgated by the state board of health covering safety and sanita-
