of the said Code, title "County Commissioners," subtitle "General
Provisions," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
118.
(b). Any public school teacher of Kent County who retired prior
to July 1, 1956, and who is receiving any retirement benefits (ex-
clusive of a disability retirement allowance) under the provisions
of this subtitle, when such benefits in the aggregate are less than one
hundred and twenty-five ($125.00) per month; shall receive an addi-
tional sum not exceeding fifty dollars ($50.00) per month upon
application to the Board of County Commissioners, and the Com-
missioners shall levy annually an amount sufficient to pay such addi-
tional benefits. The sum granted to any applicant by the County
Commissioners (subject to the fifty dollars ($50.00) limitation) shall
be such that when added to whatever the applicant is receiving from
the Teachers' Retirement System, the total shall not exceed one
hundred and twenty-five dollars ($125.00) per month. Provided
further that the Board of County Commissioners of Kent County
may, in their discretion, pay over to any retired public school teacher
covered by this section an additional monthly retirement benefit so
long as the total retirement benefit received by such public school
teacher under this subtitle and under this subsection shall not in
the aggregate exceed two thousand dollars ($2,000) per annum; and
the Commissioners are authorized to levy annually an amount suffi-
cient to pay such additional benefits.
12.
(a). The county commissioners or county council of the several
counties shall have the power and authority, in their discretion,
to pay to any school teacher of their county who is retired and who
is receiving any retirement benefits under the provisions of other
laws, where such benefits in the aggregate are less than $125.00 per
month, an additional sum not exceeding $50.00 per month upon
application to the county commissioners or county council, and said
commissioners or council shall annually levy an amount sufficient
to pay such additional benefits. Provided that the sum granted to
any applicant by the said county commissioners or council shall be
such that when added to whatever any such person is receiving
as retirement pay under other laws, the total shall not exceed one
hundred and twenty-five dollars per month. Provided further, that
in addition to the power and authority hereby conferred, the county
commissioners of Kent County shall have the authority, in their dis-
cretion, to pay additional retirement benefits as is provided by Sec-
tion 118(b) of Article 77, and shall have the authority to annually
levy an amount sufficient to pay such additional benefits.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.
SEC. 2. AND BE IT FURTHER ENACTED, THAT THIS ACT
IS HEREBY DECLARED TO BE AN EMERGENCY MEASURE
AND NECESSARY FOR THE IMMEDIATE PRESERVATION
OF THE PUBLIC HEALTH AND SAFETY, AND HAVING BEEN
PASSED BY A YEA AND NAY VOTE SUPPORTED BY THREE-
