create by reason thereof any presumption of law or finding of fact
which shall inure to or be for the benefit of any person other than the
State.

(Administrative Procedure Act).

The provisions of the Administrative Procedure Act (Article 4.1 of
the Annotated Code of Maryland, 1957 Edition, as amended) shall
apply to the provisions of this subtitle and all proceedings under this
subtitle.

704.

THE PROVISIONS OF THIS SUBTITLE SHALL NOT APPLY
TO REFUSE BURNING BY A COUNTY, MUNICIPALITY, TOWN
OR VILLAGE AT A LOCATION SUFFICIENTLY DISTANT
FROM A RESIDENTIAL, COMMERCIAL OR INDUSTRIAL
AREA SO AS NOT TO CONSTITUTE A NUISANCE; OR TO
THE BURNING OF REFUSE FROM AN INDIVIDUAL PROP-
ERTY ON THAT PROPERTY.

705.

(Severability).

If any clause, sentence, paragraph or section of this sub-
title shall, for any reason, be adjudged by any court of com-
petent jurisdiction to be unconstitutional and invalid, such judgment
shall not affect, impair or invalidate the remainder thereof, but shall
be confined in its operation to the clause, sentence, paragraph or
section thereof so found unconstitutional and invalid.

706.

(Supplemental and Additional Powers).

The provisions of this subtitle shall be regarded as supplemental
and additional to the powers and authority conferred by other laws
upon the State Board of Health and Mental Hygiene and shall not
be regarded as in derogation of any powers now existing in the State
Board of Health and Mental Hygiene.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1963.

CHAPTER 807
(House Bill 338)

AN ACT to repeal and re-enact, with amendments, Section 30-2 and
to repeal Section 30-2.1 of the Baltimore County Code, 1958 Edition
and 1961 Supplement, title "Taxicabs," revoking the authority of
the Baltimore County Council to license owners of taxicabs in the
county and the authority to provide for additional taxicabs in the
county.
