CHAPTER 3
(Senate Bill 3)

AN ACT to add five new sections to Article 26 of the Annotated
Code of Maryland (1957 Ed. ), Title, "Courts", sub-title "Municipal
Court of Baltimore City", to be known as Sections 108 through 112
inclusive, to follow immediately after Section 107, relating generally
to the salaries and pension or retirement of the Judges of said
Court, to the appointment, duties, authority, salary, retirement and
bonding of the clerks of said Court, and to the collection and re-
mission of fines and costs, and general financing, in and of said
Court, and providing that this bill shall be an emergency measure,
effective immediately, and shall terminate at the time that, and
on condition that, Chapter 616 of the Acts of the Regular Session
of 1961 takes effect.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That five new sections be and they are hereby added to Article 26 of
the Annotated Code of Maryland (1957 Ed. ), Title, "Courts", sub-
title, "Municipal Court of Baltimore City", said new sections to be
known as Sections 108 through 112 inclusive, to follow immediately
after Section 107 and to read as follows:

108. Judges.

(a) The Chief Judge of the Municipal Court of Baltimore City
shall be paid a salary of $16, 000 per annum. The Associate Judges
of said Court shall each be paid a salary of $15, 000 per annum.

(b) Retirement.

(1) Every elected Judge of the Municipal Court of Baltimore City
shall be paid, after the termination of his active service, if he is
then at least sixty years of age or when he becomes sixty years of age,
a pension or salary calculated at the rate of Three Hundred Fifty
Dollars ($350. 00) per annum for each year or any part thereof of
active service by appointment and election as a Judge of said
Municipal Court, up to and including twenty years of such active
service, so that a maximum pension or salary for such service pay-
able hereunder to any one person shall not exceed the sum of Seven
Thousand Dollars ($7, 000. 00) per annum. Any former Judge who
accepts any salaried public office or position, municipal, county, state
or federal, shall not be paid any such pension or salary so long as
he remains in any such office or position. No pension shall be pay*
able hereunder to any retired Judge of the Municipal Court of Balti-
more City who is receiving another pension under the Employees9
Retirement System of the City of Baltimore or the Employees' Re-
tirement System of the State of Maryland.

(2) The widow of every elected Municipal Judge who dies in active
service shall be paid one-half of the pension or salary the Judge
would have received if his service had been terminated by retire-
