(e) In the Chester River, and the tributaries thereof, including
Reed's Creek and the Corsica River, unless herein specially pro-
hibited, without limitation arising from a designation of oyster bars
or natural oyster bars on the charts of the Commission of Tidewater
Fisheries; provided, however, that nothing herein contained shall
permit the taking or catching of soft shell clams within fifty (50)
yards of any commercially productive oyster area.

(3) Nothing in this section shall be construed to prevent or pro-
hibit the Department of Research and Education and/or the Com-
mission of Tidewater Fisheries from conducting scientific investiga-
tions of any nature, at any time, by the use of any devices, proce-
dures or means, in any of the waters of Queen Anne's County, or the
waters of the Chesapeake Bay adjacent thereto, anything to the con-
trary in this section notwithstanding.

(r) Penalties.Any person violating any of the provisions of
this section shall be deemed guilty of a misdemeanor and upon con-
viction thereof, unless otherwise herein specified, shall be fined not
less than ten dollars ($10.00) nor more than two hundred dollars
($200.00).

(1) Excepting violations of sub-titles (c), (d), (e), (f) and (j),
any person found guilty by a court of law of three violations of the
provisions of this section within any twelve (12) month period may,
in addition to the fine herein prescribed, have his license suspended
or revoked by the Commission of Tidewater Fisheries, after a hear-
ing thereon by the Commission after ten (10) days notice to the
licensee, served by registered mail to the addressee only, or by per-
sonal service by the Commission or its duly authorized officers.

(2) All violations of this section by resident licensees, or by others
residing in Queen Anne's County, shall be tried by the Trial Magis-
trate for Queen Anne's County, anything to the contrary in this
Article notwithstanding; but nothing herein contained shall deny
to any defendant the right to waive the jurisdiction of such Trial
Magistrate, or to appeal to the Circuit Court for Queen Anne's County
from any ruling, decision or finding of such Trial Magistrate.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1959.
