ANNOTATED CODE OF MARYLAND (1951 EDITION AND
1956 SUPPLEMENT), TITLE "STATE ROADS", SUB-TITLE
"DUTIES AND POWERS", SAID NEW SECTION TO BE
KNOWN AS SECTION 62A AND TO FOLLOW IMMEDIATELY
AFTER SECTION 62 THEREOF, PROVIDING THAT THE
STATE ROADS COMMISSION SHALL PAY CERTAIN REAL
ESTATE TAXES ON CERTAIN PROPERTY IT ACQUIRES
UNDER CERTAIN CONDITIONS.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 17 of Article 33A of the Annotated Code of Maryland
(1951 Edition), title "Eminent Domain", be and it is hereby repealed
and re-enacted, with amendments; that new Section 17A be and it
is hereby added to said Article and title to follow immediately after
Section 17 thereof, and both to read as follows:

17. The State, and any municipal or other corporation, commis-
sion, board, body or person, which under the laws of this State, has
a right to acquire property by condemnation, shall acquire such prop-
erty, if condemnation proceedings be resorted to, in pursuance of,
and under the provisions of this Article, anything in any other Public
General Law or Public Local Law or private or special statute to the
contrary notwithstanding; provided, however, that nothing in this
Article contained except Section 17A shall apply to or change the
present law or procedure for the opening, closing, widening, or
straightening of highways, except that the State Roads Commission
may, at its discretion, acquire property by condemnation under the
provisions of this Article.

17A. Whenever the State or any municipal or other corporation,
commission, board, body or person including the State Roads Com-
mission which under the laws of this State has a right to acquire
property by condemnation, institutes condemnation proceedings
against private property, there shall be an abatement of real proper-
ty taxes in favor of the condemnee
AND IN ALL SUCH PROCEED-
INGS THERE SHALL BE AN ADJUSTMENT IN REAL PROP-
ERTY TAXES AND THE CONDEMNOR SHALL BE REQUIRED
TO PAY OVER TO THE CONDEMNEE ALL SUCH TAXES PAID
IN ADVANCE BY SUCH CONDEMNEE CALCULATED either
from the time the condemnor takes possession or has the right to
take possession of the property condemned or upon the actual trans-
fer of title to the property to the condemnor, whichever occurs first,
any provision to the contrary in the laws of this State notwithstand-

ing. Such taxes then accruing shall be paid by the condemnor.

SECTION 2. BE IT FURTHER ENACTED BY THE GENERAL
ASSEMBLY OF MARYLAND,
THAT A NEW SECTION BE AND
THE SAME IS HEREBY ADDED TO ARTICLE 89B OF THE
ANNOTATED CODE OF MARYLAND (1951 EDITION AND 1956
SUPPLEMENT), SAID NEW SECTION TO BE KNOWN AS
SECTION 62A AND TO FOLLOW IMMEDIATELY AFTER SEC-
TION 62 THEREOF, AND TO READ AS FOLLOWS:

62A. IN ALL CASES WHERE THE STATE ROADS COM-
MISSION ACQUIRES BUILDINGS USED FOR RESIDENTIAL,
COMMERCIAL OR INDUSTRIAL PURPOSES OR ACQUIRES
ALL OR SUBSTANTIALLY ALL OF A PARCEL OF UNIM-
