chapter 41.
An act to straighten and make public a Road in Prince
George's County.
Whereas it is represented to this general assembly, by the
petition of sundry inhabitants of Prince-George's county, that it
will greatly conduce to the convenience of the people of that part
of said county, to straighten and make public the road leading
from the Piscataway road, near John Palmer's tavern, passing
through the lane between the lands of the late Peter Savary and
William Bayne, senior, and intersecting the road from Upper
Marlborough to Thomas Berry's ferry, at Francis Perkins's ;
and the prayer of the petitioners appearing reasonable, Therefore,
Sec. 1. Be it enacted by the General Assembly of Maryland, That
George H. Lanham, Thomas Berry and Edward C. Edelin, be,
and they are hereby appointed commissioners, and they, or a
majority of them, are hereby authorised and empowered to re-
view the private road now leading from the Piscataway road,
near John Palmer's tavern, passing through the lane between
the lands of the late Peter Savary and William Bayne, senior,
and Intersecting the road from Upper Marlborough to Thomas
Berry's ferry, at Francis Perkins's, and the same to straighten,
lay out, survey, mark and bound, not exceeding thirty feet in
width, and to make a plot of said road, when so straightened,
laid out, surveyed, marked and bounded, and return the same,
under their hands and seals, to the clerk of Prince-George's
county court, to be by him recorded among the land records of
said county; and the levy court of said county, at any meeting
after the said plot shall have been returned and recorded as afore-
said, are hereby authorised and empowered to appoint a super-
visor or supervisors to keep said road in repair, as other public
roads are in said county; and the said levy court are hereby further
authorised and empowered to levy and assess, upon the assessable
property of said county, at the time of laying their next county
levy, a sum of money in their opinion sufficient to defray the
expense arising in the execution of this1 act.
2. And be it enacted, That the said commissioners, or a ma-
jority of them, shall ascertain and value the damages which any
person or persons may sustain through whose land the said road
may pass, by straightening, laying out, opening, and clearing
the same, and shall make and return to the levy court of said
county, a certificate of such valuation, the amount of which shall
be levied by said court on the assessable property of said coun-
ty, and paid to the person or persons entitled thereto.
3. And be it enacted, That the said commissioners be allowed the
sum of two dollars each per day as a compensation for their services.
