Plot to be re-

corded.

4. And be it enacted, That the said commissioners or a ma-
jority of them, are hereby directed to return a plot of the said
wharf and lumber-yard when surveyed, marked and laid out as
aforesaid, to the clerk of the county court, to be by him recorded;
which wharf and lumber-yard when laid out, shall be deemed and
taken as a public wharf and lumber-yard, forever thereafter; and

Proviso.

shall be kept up and repaired as all other public wharfs in said
county are; Provided, That nothing herein contained, shall, in any
manner authorise the said commissioners to lay out the said wharf
and lumber-yard through the buildings, garden, orchard or yard of
any person or persons without his, her or their consent.

CHAPTER 65.

An act to authorise and empower the Levy Court of Anne Arundel
county, to assess and levy a sum of money for the purposes therein
mentioned.

Levy—for what
purpose.

Sec. 1. Be it enacted By the General Assembly of Maryland,
That the Levy Court of Anne Arundel county, be, and they are
hereby authorised and empowered to assess and levy on the asses-
sable property of said county, such sum of money, and in such an-
nual installments as they may deem sufficient for the purposes of
finishing [furnishing] the court-house of said county with the neces-
sary cases for the reception of the public records, and with all neces-
sary furniture for the accommodation of the court and members of

the bar, and such other things as their convenience may require.

Subject to
whose order.

2. And be it enacted, That the said sum or sums of money,
when collected, shall be subject to the order of John T. Barber,
Richard Harwood, (of Thomas) and James Shaw, to be by them
applied in carrying into effect the object of this act, under the like
responsibilities and penalties as are imposed upon them by an act
passed at December session eighteen hundred and twenty, entitled,
An act to provide for the building of a court-house in Anne Arun-
del county.

CHAPTER 66.

A further additional supplement to an act entitled, "An act for the erec-
tion of a new Market-House in Hager's-Town, in Washington
county, and for other purposes.''
Whereas, By authority of an act passed by the general assem-
bly of Maryland, at December session eighteen hundred and nine-
teen, chapter 185, commissioners were appointed, who have, agree-
ably to the directions of said act, selected and purchased as a site
for a Market-house in Hager's-town, from Barnhard Lowman,
Frederick Bell and Peter Bell, lot number seven in said town; and
the moderator and commissioners of Hager's-Town believing that
said lot contains more ground than is necessary for said market-
house, and being desirous to sell a part thereof, and to appropriate
the money thence arising to the erection of said market-house; and
being doubtful whether they have any authority to sell and convey
by deed any part of said lot, or whether a deed executed to them
from said Barnhard Lowman, Frederick Bell and Peter Bell, would
be valid in law—Therefore,
