on the land of the person or, persons making applica-
tion as aforesaid, or for whose benefit such application
shall be made; and the said free holders, having first
made oath, before some justice of the peace, that they
will without favor, affection or partiality, assess the
damages sustained by the person or persons at whose
request such inquisition shall be taken, by reason of
opening the aforesaid road through his, her or their
land, shall thereupon proceed to assess and value the
damages accordingly, taking into consideration the
advantages and disadvantages, (if any; ) of which
the said commissioners, or a majority, shall have at
least five days notice, and shall return the damages
so assessed, to the said justice of the peace, and such
inquisition and valuation shall be final and conclu-

sive: Provided, That the said road shall not pass
through any house, yard, garden or orchard, without
the consent of the owner or owners thereof.

CHAPTER 177.

29, 1812.

An act to alter, change and repeal all such parts of
the Constitution and form of Government of this
State, as relate to the division of Prince George's
county into election districts.

Preamble.

WHEREAS, It is represented to this General As-
sembly of Maryland, by the petition of sundry inhab-
itants of Prince George's county, that they experi-
ence great inconvenience for want of a sixth district
in said county, and praying an alteration in the se-
cond, third and fifth districts, so as to admit a sixth
between them; and the prayer of the petitioners ap-
pearing reasonable: Therefore,

Act of 1798
repealed.

SEC. 1. BE IT ENACTED by the General As-
smbly of Maryland, That all that part of the consti-
tution and form of government, made such by the act
of seventeen hundred and ninety eight, which directs
that Prince George's county shall be divided and laid
off into five separate districts be, and the same is
hereby repealed.

Additional
district.

2. AND BE IT ENACTED, That Prince
George's county shall be divided into six separate dis-
tricts, and that the additional district shall be laid off
adjoining and between the second, third and fifth dis-
tricts.

This act be-
ing, confirmed
as required, it
shall take ef-
fect.

3. AND BE IT ENACTED, That if this act
shall be confirmed by the General Assembly of Ma-
ryland, after the next election of delegates in the first
session after such new election. as the constitution and
