and all sanitary features connected therewith; no rule or
regulation, however, to carry a higher penalty than One Hun-
dred Dollars for each offense and all such rules and regula-
tions to bear the seal of the State Board of Health and be
attested by its secretary.

SEC. 2. And be it further enacted, That this Act shall take
effect June 1, 1949.

CHAPTER 312

(House Bill 14)

AN ACT to repeal and re-enact, with amendments, Section
327 of Article 43 of the Annotated Code of Maryland (1939
Edition), title "Health", sub-title "Undertakers", eliminat-
ing the provision providing that the Director of the State
Board of Health and the Commissioner and Assistant
Commissioner of Health of Baltimore City shall be mem-
bers of the Board of Funeral Directors and Embalmers.

SECTION 1. Be it enacted by tine General Assembly of Mary-
land, That Section 327 of Article 43 of the Annotated Code of
Maryland (1939 Edition), title "Health", sub-title "Under-
takers", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

327. The members of the State Board of Undertakers of
Maryland as at present constituted shall constitute the State
Board of Funeral Directors and Embalmers of Maryland, and
shall hold office for the residue of the respective terms for
which they have been appointed. Thereafter the Governor, by
and with the advice and consent of the Senate, shall biennially
appoint seven licensed Funeral Directors and Embalmers,
residents of the State of Maryland, who shall have been
actively engaged in their profession for the last five years
immediately preceding their appointment, five of whom shall
be residents of Baltimore City and two residents of the
counties, who together with the Director of the State Board
of Health, or some person designated by the said Director,
as an ex officio member, shall constitute the State Board of
Funeral Directors and Embalmers of Maryland, and they
shall take the oath prescribed by the Constitution of Mary-
land. The members of the said Board shall hold office until
their successors are duly appointed and qualified; any vacancy
