which he may voluntarily retire or at which the official or
body appointing such member may determine that such
member is no longer needed, provided, however, that no
such member shall be retained or reinstated when there
is available to fill his position an eligible and qualified
person below the age of seventy (70); eligibility and quali-
fication to be determined by the official or body authorized
to fill the position of the member in question.

Should any beneficiary under the Teachers' Retirement
System be restored to active service under the provisions
of this sub-section all allowances that he is receiving under
such system shall cease. He shall again become a member
of the Retirement System and he shall contribute there-
after at the same rate he paid prior to retirement. Any-
thing in this Article to the contrary notwithstanding, any
prior service certificate on the basis of which his service
was computed at the time of his retirement shall be restored
to full force and effect, and in addition, upon his subsequent
retirement he shall be credited with all his services as a
member. Provided however that nothing in this Section
shall apply to any teacher, helping teacher, principal, super-
visor or superintendent, attendance officer or clerk, em-
ployed in a public school within the State.

SEC. 2. And be it further enacted, That this Act is
hereby declared to be an emergency measure and necessary
for the immediate preservation of the public health and
safety and having been passed by a yea and nay vote, sup-
ported by three-fifths of all of the members elected to each
of the two houses of the General Assembly, the same shall
take effect from the date of its passage.

AN ACT to repeal and re-enact, with amendments, Sec-
tions 147, 148, 149, 150, 151, 153, 157 and 161 of Article
10 of the Code of Public Local Laws of Maryland (1930
Edition), title "Dorchester County", sub-title "County
Commissioners and Treasurer", sub-heading "Board of
Estimates", Section 153 having been amended by Chap-
ter 366 of the Acts of 1933, making the provisions of said
sections conform to the resolution of the County 'Com-
