by the Acts of 1922, Chapter 96, providing for Police
and Fire Departments and the appointment of Civil
Service Commissioners and examinations for the Police
and Fire Departments in the City of Cumberland, and
to define the qualifications, powers and duties of said
Commissioners.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 36 of Article 1-A of the Code of
Public Local Laws of Maryland, title, "Allegany County, "
sub-title, "Cumberland, " as enacted by the Acts of 1922,
Chapter 96, be and the same is hereby repealed and re-
enacted with amendments, so as to read as follows:
Section 36. Said Mayor and City Council shall have full
power and authority to establish and maintain a Police
Department, to be composed of a Chief of Police, an
Assistant Chief of Police and a Lieutenant of Police and
such number of policemen as said Mayor and City Council
may by Ordinance deem necessary, said officers and
members of said Police Department to be appointed
and their duties to be fixed, defined and regulated
as hereinafter provided; and shall also have power and
authority to establish and maintain a Fire Department, to
procure fire engines and other apparatus for the extinguish-
ment of fires and provide engine houses for keeping and
preserving the same, and said fire department shall be com-
posed of a Chief of the Fire Department, an Assistant Chief
of the Fire Department and such number of firemen as the
said Mayor and City Council may deem necessary, the offi-
cers and members of said fire department to be appointed
and their duties to be fixed, defined and regulated as here-
hereinafter provided.
The Mayor and City Council at their first meeting in the
month of June 1916, shall appoint three Civil Service Com-
missioners, one of whom shall hold office until the first
Monday in April, 1918, and one until the first Monday in
April 1920, and one until the first Monday in April, 1922,
and on the first Monday in April, 1918, and on the Monday
in April biennially thereafter, shall appoint one Civil Ser-
vice Commissioner to serve for a term of six years, so that
the said Board of Civil Service Commissioners shall always
consist of three members.
The Chairman of the Commission for each biennial
period shall be the member whose term first expires. No
person, while on the said commission, shall hold or be a
candidate for any office of public trust. Two of the said
members shall constitute a quorum to transact business.
The Commissioners must be citizens of Maryland and resi-
