land, by Sections 1 and 2 of this Act shall become operative and
effective; but in the event that a majority of the votes so cast
shall be against the amendment allowing the special tax for the
purpose of establishing and maintaining a garbage and/or ash
and/or trash collection and disposal service within the corporate
limits of the town of Mount Rainier, then the power and
authority vested in the Mayor and Common Council of Mount
Rainier by Sections 1 and 2 of this Act shall not become opera-
tive and effective; but a like petition such as described in this
section may be presented to the said Mayor and Common Coun-
cil from time to time thereafter and upon the presentment of
any such petition, it shall be the duty of said Mayor and Com-
mon Council of Mount Rainier to submit the question to the
qualified voters of said town at an election in the same manner
. as provided in this section and the powers and authorities vested
in the Mayor and Common Council of Mount Rainier, Mary-
land, by this Act shall become operative and effective only when
a majority of the voters of said town approve said question in
the manner provided for herein.

SEC. 5. And be it further enacted, That this Act is hereby
declared to be an emergency law, necessary for the preservation
of the public health and safety, and being passed upon a yea
and nay vote, supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, the
same shall take effect on the date of its passage.

CHAPTER 139.

AN ACT to authorize and empower the Mayor and Common
Council of Mount Rainier, Maryland, with the approval of
the qualified voters of said town, to levy and collect annually
a special assessment of not to exceed ten cents, on a hundred
dollars based on the assessed valuation of all real and per-
sonal property in the town, appearing on the books of the
town treasurer; the tax so levied and money collected there-
on to be paid to the Mount Rainier Volunteer Fire Depart-
ment as long as it provides adequate fire protection to the
residents and property within the corporate limits of the
town of Mount Rainier, said money to be used by the said
