charter of the town of Mount Rainier for the collection of taxes
in Mount Rainier and amendments thereto.
SEC. 3. And be it further enacted, That the money realized
from such special assessment shall be kept by the Town Clerk
and Treasurer of Mount Rainier in a special fund and shall be
used for no purposes other than that specified in this Act. Any
surplus arising from such assessment in any year shall be consid-
ered by the Mayor and Common Council in making the levy for
the succeeding year and such surplus shall be used, together
with the money realized from the new levy, for the purposes
set forth in Section 1 of this Act.
SEC. 4. And be it further enacted, That the powers granted
to the said Mayor and Common Council of Mount Rainier by
Section 1 hereof shall not become operative until a petition
signed by at least ten per centum of the qualified voters of the
town of Mount Rainier, Maryland, as shown by the registration
books used at the then last regular municipal election, shall be
presented to the said Mayor and Common Council of Mount
Rainier, Maryland, requesting that the following question be
submitted to the legal voters of said town, to wit: "Shall a
tax of not to succeed 20c. on each $100. 00 of the assessed valua-
tion of all real and personal property within the town of Mount
Rainier appearing on the books of the town treasurer be levied
each year for the purpose of providing a fund to be used ex-
clusively for the establishment and maintenance of a garbage
and/or trash and/or ash collection and disposal service within
the corporate limits of the town"; and when such petition shall
have been received by the Mayor and Common Council of
Mount Rainier, they shall cause said question to be submitted
to the qualified voters of said town at an election to be held as
hereinafter provided.
The date of said election shall be fixed by the Mayor and
Common Council and notice thereof shall be given by advertise-
ment in some newspaper published within the town of Mount
Rainier, and if there be no such paper or if the charges of
such paper for said advertisement shall be in excess of the
standard rates heretofore adopted by the newspaper publishers
of Prince George's County for similar advertising, then in a
newspaper published in Prince George's County which has a
circulation in the town of Mount Rainier, once a week for two
successive weeks prior to said election, and also by posting
