703 of this Court by his certain bill or Writing obligatory sealed with his seale as his Act and deed delivered and here in Court brought whose date is the same day and Yeare did bind himselfe his Heires Exec.rs and Adm.rs to pay or cause to be paid unto the said Thomas Theakston his Heires Execut.rs Adm or assignes the said 1200.ll Tob quallified as aforesaid convenient in said County att or upon the Tenth day of November then next ensueing the date of the same bill Yett Notwithstanding the said John Bowles the said sume of 1200.ll of Tobaccoe according to the Ten.r of the same bill unto the said Thomas Theakston he hath not paid alltho often demanded but the same to pay he hath denied and refused to the damage of the said Thomas Theakston Two Thowsand poundes of Tobaccoe and therupon he brings this suit Hemsley p q.r pledg &c.a Jn.o Doe Ri Roe And the said John Bowles in his proper person comes and prayes discompt according to Act of Assembly in such case made and and provided of his certain Acc.o here in Court brought amounting to the sume of Eight hundred and Fifty poundes of Tobaccoe which Acc.o being proved and that the said goods were delivered to Thomas Parker in part satisfaction of the above menconed Bill to whome the said bill was delivered to Thomas Theakston proved in open Court by the Oath of the said John Bowles Judgm.t is therfore awarded for the Ball.a being 350.ll of Tob Therfore it is considered by this Court that the plt Tho Theakston doe recover from the Defend.t John Bowles as well the sume of Three hundred and Fifty poundes of Tobaccoe as allsoe the sume of Two hundred Forty and seaven poundes of Tobaccoe cost of suit Simon Wilmer Clk Court adjournes untill to Morrow Eight of y.e clock |
