Kent fs Daniel Norris of Kent County Gent standeth attached to answer unto Peter Peterson Carpenter of a plea of Trespasse upon the case &c.a And whereupon the said Peter Peterson by Griffith Jones his Attorney complaineth and saith that the said Norris within the Jurisdicon of this Court stood justly indebted unto him the sayd Peterson the full and just sume of five hundred forty and seaven pds of Tobaccoe as by a certaine acc.o bearing date in October Anno (91) to Anno 1695 & here Court produced may more att large appeare which sayd sume of Five hundred Forty & seaven pds of Tobacco allthoug often demanded to pay Yett the said Norris little regarding but nastily intending to deceive him the sayd Peterson of the aforesd sume he hath not pd but still doth refuse and denie to the damage of the sayd Peterson One Thowsand and Eighty poundes of Tobaccoe and therupon he bringeth this suit Jones p qr Jn.o Doe pledg Ri Roe
and the Matter therin contained he cannot nor by the Law of the Land is he bound wherfore for want of a sufficient declaracon and for want of sufficient matter in the same to be containd the said Defend.t prayes Judgm.t &c.a Hemsley p defend.t And the said declaracon is by this Court Judged to be insufficient Judgm.t is the fore Awarded for a Non suit Therfore it is considered by this Court that the defend.t Daniel Norris doe Recover as well the sume of Fifty pounds of Tobaccoe for a Non suit as allsoe the sume of One hundred and seaventy poundes of Tobaccoe cost of suit Simon Wilmer Clk |
