Smith the sume of Fower Thowsand poundes of Tobaccoe and in the hands of Capt Edward Sweatnam the sume of Sixteene hundred poundes of Tob as in the proceedings of this Court then held doth appeare To which said Attachm.t Major Thomas Smith now appearing and declaring to this Court that he had noe Tobaccoe in his hands as attached by the sheerif but that he had sworne papers in his hand belonging to the said Heath It is therfore ordered by this Court that the plt Joshua Hollingshead have Attachment alsoe y.e Bills Bonds Bookes or papers belonging to the said Richard Heath in the hands of Major Thomas Smith Simon Wilmer Clk The sheerif haveing returned as above the said Attachm.t attached in the hands of Capt Edward Sweatnam y.e sume of sixteene hundred poundes of Tobaccoe as aforesaid which being continued from Court to Court from y.e said 27.th day of August and no Just cause Appearing why the same should not be condemned It is therfore ordered by this Court that the said sume of sixteen hundred poundes of Tobaccoe in the hand of Capt Edward Sweatnam be Condemned for the use of the plt Joshua Hollingshead Simon Wilmer Clk Major Thomas Smith sitts againe |
