June Court 1760 27 To ye. Bounds of a tract of Land Called Promfrett or any other Lands on which the afd. Land may Depend We Therefore require you or any three or two of you at somtime and place as to you or any three or two of you it shall seem Convenient you meet on ye. afd. Land Called Pomfret or any other Lands on which ye. Bounds of ye. afd. Land may Depend you first having taken your Oaths on ye. Holy Evanglist of Almighty God and their Cause to Come before you or any three or two of you all Such Evidences as shall be to you or any three or two of you Nominated by ye. said Complainant or Deft. and that you or any three or two of you Examine them upon their Corporal Oaths to be by you or any three or two of you administred on ye. Holy Evangels of Almighty God in ye. pres: :ence of ye. Complainant or Deft. if Any Touching the truth or remembrance of their knowledge or any thing that may relate to ye. Cause afd. and that Reducing ye. severall Depositions into Writing you send ye. Same with this our Commission under your or any three or two of your Hands and Seals to us to our County Court of Somerset with all Convenient Speed Witness Isaac Handy Eqr. one of our Justices of our said Court this 2d. Day of March in ye. 8th. year of our Dominion & Anno Dom. 1759 Att A Court of his Lordships held at Princes Ann Town ye. third Tuesday of June Anno Dom. One thousand seven hundred and Sixty before ye. Justices thereof Came James Gunby & Josephas Bell two of ye. gentleman nominated in ye. within Commission and returned ye. Same indorsed in manner following April ye. 19th. 1759 then was Josephas Bell Qualified to Execute ye. within Commission agreeable to Act of Assembly in Such Case made and provided before me SWheatley 3d. Day of May 1759 James Gunby was also Quallified to Execute ye. within Commission agreeable to Act of Assembly Before Th. Jones Somerset County fst The Deposition of Benjamin Langford Aged fifty two years or there about being Sworn on ye. Holy Evangelist of Almighty God Deposeth as Follows (vizt) that about Twenty years ago he ye. said Lankford was a Chain Carrier to lay of Some Land for Capt. Holland and that they Begun at a marked Seder post which is now gone and from thence they run South fifty five Degrees West to a marked Oak being ye. first bounder of a Tract of Land called Ferebridg about thirty two poles and a half Distant from ye. afd. post which said Sedar post ye. said Lankford Declars he Saw many years before he Carried Chane and that Old Capt. Holland and Anthony Bell and Nathaniel Horsey all Deceased told this Deponant that ye. afd. post was ye. first Bounder of a Track Land Called Pomfret and this Deponant Declares that along ye. Division Fence Between Stephen Horsey and Michael Holland Junr. ye. afd. Post Stood and to ye. Best of his Remembrance in or near ye. place where Wm. Coulbourn Setled a Sedar post this Day which is marked with Sixteen Marks ye. afd. Post Setled by Coulbourn is to ye. Westward of ye. afd. Fence and about Forty five yards to ye. Westward of ye. County road and about one hundred & ten yards to ye. South Eastward of ye. Head of Coulbourns Creek & this Deponant further Saith not |
