132 ~ Court convenes: Commissioners present: Francis Jenckins, James Round, Capt. John King. Stephen Horsey.

 

132 ~  John Poore, Neal Mccoy (Macoy), Pltfs. vs. John Strawbridge. Deft. for debt of 1300 lbs/tbco; Sam Worthington, attorney for plaintiffs, presents note signed 27 November 1693 at Manokin by Strawbridge asking his friend Robert Catlin to give Poore & Mccoy (Macoy) credit for rent at plantation of Bryan Conevey, held by Strawbridge, in return for their building him a boat; Peter Dent, for Strawbridge, admits debt; Court orders payment with costs.

 

133 ~  John Tayler, Pltf. vs. John Strawbridge, Deft. for 1280 lbs/tbco; Edward Jones, attorney for Tayler, claims debt comes from agreement made in 1687 between them for conveyance of land; credit of 500 lbs/tbco had been given to Andrew Whittington, and 140 lbs to Joseph Thaxter’s store; Strawbridge had subsequently sued Tayler for 1280 lbs/tbco and now he claims indemnity of 3000 lbs/tbco; Sam Worthington, for Strawbridge, claims the matter was not within jurisdiction of the Court, nor had any Court action been taken; Court rules a non-suit.

 

133 ~  Thomas Poole, Pltf. vs. Gregory Murmurenough, Deft.; Sam Worthington, attorney for Poole, claims damages from Murmurenough shooting and killing Poole’s “black stone horse” valued at 800 lbs/tbco, at Back Creek; Peter Dent, for Murmurenough, asks for a non-suit since Worthington had not signed declaration or provided any security for prosecution; Court rules a non-suit.

 

134 ~  Mr. James Round, Pltf. vs. Robert Howard, Deft. for debt of  100 lbs/pork; Peter Dent, attorney for Round, claims debt due for transport of goods to St. Maries, per note Round signed 7 June 1694; Sam Worthington, for Howard, asks for a non-suit since Dent had not signed the declaration or provided any security for prosecution; Court rules a non-suit.

 

134 ~   John Tayler, Pltf. vs. John Strawbridge, Deft; scieri facias for 200 lbs/tbco due from previous judgement; Strawbridge claims Tayler owes him a greater debt; case dismissed.

 

134 ~  Ephraim Wilson, Sheriff, Pltf. vs. Matthew Jones & Walter Evins, Defts; Wilson claims bail bond for non appearance of Jones, or Evins his security, in suit brought by Ellis Coleman at August Court; Jones appears and confesses debt as originally claimed by Coleman for 122 lbs/pork; Court orders he pay, with costs.

135 ~  Deposition of John Henry, aged 30, dated 4 September 1694;  states that in 1693 he had been aboard the Brigantine Stephen & Mary, owned by Stephen Horsey, captained by William Round, bound for Barbados with a large quantity of tobacco, mostly belonging to John West; on 8 June 1693 the vessel had been seized by the French near the Isle of Ash.

 

136 ~  Deposition of William Round, aged 32, dated 12 September 1694; states that in May 1693 Stephen Horsey made him ships master of Horsey’s ship bound for Barbados, with a large cargo of tobacco belonging mostly to John West, Court Clerk of Somerest; on 8 June 1693 the ship was taken by the French.
