110 ~  Court convenes; Commissioners present: Francis Jenckins, James Dashiels, Roger Woolford, Edmund Howard, Capt. John King, Stephen Horsey, Capt. Arnold Elzey.

 

111 ~  Francis Jenckins, Pltf. vs. Peter Whaples, cordwinder, Deft.  for 2679 lbs/tbco; Peter Dent, attorney for Jenckins, presents bill of debt signed 22 May 1689 by Whaples promising delivery by 10 October following; witnesses William Woodland, Anne Woodland; affidavit signed by Martin Trentham presented with original writ of suit returned sed fugit; Court orders that the Sheriff is liable and “be amerced according to law for his false return of his writt”; required to pay 2679 lbs/tbco; Jenckins to pay costs.

 

111 ~  Petition of Richard Tull and George Noble for license to operate an ordinary at Dividing Creek “hoping thereby to become servicable to the County” (probably at new Courthouse); Court grants license to Tull only; memorandum: Jenckins left bench during trial, Dashiels sat as president.

 

112 ~ Francis Jenckins presents account against estate of Archibald White with balance due of 8861 lbs/tbco; account mentions items of Michael Clugstone, Nicholas Lisney, Mr. Makemie, Walter Lane, John West, James Noble; Pierce Bray, administrator for estate, admits debt; Court orders payment, with costs.

112 ~  William Harvey Pltf. vs. Thomas Shiles, Deft. for a cow and calf valued at 1200 lbs/ tbco; Samuel Alexander, attorney for Harvey, states that on 10 May 1693 Shiles prevented Harvey from retrieving the cow and calf from Harvey’s land and has not permotted it since; Sam Worthington, attorney for Shiles, denies charges; Sheriff calls Jury: William Turvile, John Henderson, John Parsons, Robert Crowe, Robert Smith, John Richins, Walter Talbott, Benjamin Deards, Roger Odowey, Edward Wright, John Webb, William Scott; Jury finds for Shiles; Court confirms.

 

112 ~  Hope Tayler, Pltf. vs. William Henderson, Deft. for 400 lbs/tbco; Sam Worthington, attorney for Tayler, presents bill of debt signed 8 June 1689 by Henderson promising delivery to Pocomoke by 10 October following; Robert Pirrie, for Henderson, does not dispute bill but says it was payment for Tayler weaving 66 yards of cloth, and only 31.5 yards was done; only 189 lbs/tbco should be due; Court rules for Tayler, requires Henderson to pay full amount, with costs.

 

113 ~  Petition of Thomas Porter to be discharged from his bond for good behavior; granted.

 

113 ~  Pierce Bray, wife Mary, Pltfs. vs. Thomas Dixon, Deft. for 600 lbs/tbco due to the estate of Archibald White; Samuel Alexander, attorney for Bray and wife Mary, widow of White, claims debt is due from 10 August 1691; no bill presented; Peter Dent attorney for Dixon pleads non assumpsit; Court rules a non-suit.

 

114 ~  John Strawbridge, Pltf. vs. John Rowell, cordwinder, Deft. for debt of 1730 lbs/tbco; Robert Pirrie, attorney for Strawbridge, presents Strawbridge’s account for Rowell and also two bills of debt, one on 7 July 1692 for six pair of shoes for John and Thomas Ellis, and one for  7 pair of French fall shoes for 600 lbs/tbco, signed 13 August 1692 by Rowell; witnesses John and James Strawbridge, Bernard Ward, Edmund Mullavell; account mentions John & Thomas Ellis, James Berry, Wilt. Duffe (?), John Ennalls, Moses Owens, Teague Riggen, William Matthews, Andrew Whittington, Maj. King, James Poole; Peter Dent, attorney for Rowell enters non sum informatus; Court orders Rowell to pay, with costs.
