34 ~  Court convenes; Commissioners present: Francis Jenckins, Capt. John Winder; James Round, Capt. John King, Stephen Horsey, Arnold Elzey.

 

34 ~  George Goddard, Pltf. vs. Mrs. Sarah Brereton, widow and excecutrix of William Brereton, Deft. for 415 lbs/tbco; Peter Dent, attorney for Goddard, presents account for various items charged to William Brereton; Court rules a non-suit.

 

35 ~  Bond of Henry Lynch to George Layfield proved in court.

 

35 ~ Capt. Henry Smith, Pltf. vs. Thomas Davis, sawyer, deft. for 3456 lbs/tbco; Peter Dent, attorney for Smith, presents bond signed 4 August 1690 by Thomas Davis and Thomas Miller, obligating them to deliver 2160 feet of cypress plank to Smith by following March; witnesses Robert Pirrie, Peter Dent; Davis admits debt; Court orders payment, with costs.

 

36 ~  George Andrews, mariner, Pltf. vs. Capt. John Sayer (Sawyer), mariner, Deft.; Peter Dent, attorney for Andrews, claims he is due £17/10/0 for 7 months service on the ketch Jersey from Janaury 1692/3 to August 1693; Samuel Worthington, for Sayer, asserts that Andrews received £10/19/6 which was sufficient, since Andrews refused to perform his duties and had left ship, now idle for want of crew;  Andrews claims he was lawfully discharged from vessel; Court rules that no lawful discharge had been given, declares a non-suit; Michael Holland to pay costs for Andrews.

 

37 ~  Michael Holland, Pltf. vs. John Sayers (Sawyers), mariner, Deft. for £2/4/0; Samuel Alexander, attorney for Holland, claims debt is for time working on Sayer’s vessel and also from an account of Sayers assigned to him by a Michael Smith, citing charges from 28 September 1692; Court rules a non-suit;

 

38 ~  Case against Mr. David Robinson for being drunk in his own house in Bogaternorten; no evidence produced; Court dismisses case; Robert Pirrie to pay fees.

 

38 ~ Case against Esther James; no indictment filed, nor was anyone familiar with the person; case quashed.

38 ~  Robert Christee, Pltf. vs. James Maynard, innholder, deft. for 1322 lbs/tbco; Peter Dent, attorney for Christee, presents invoice dated 28 March 1692 at Pocomoke listing charges for various amounts of liquors provided by Christee; Samuel Alexander, attorney for Maynard, admits charge; Court rules for Christee.

 

39 ~  George Layfield, and wife, Pltf. vs. Thomas Kinsay, Deft. for 4553 lbs/tbco; Peter Dent, attorney for plaintiffs, presents note of debt to Elizabeth Stevens, now Layfield’s wife, signed 28 February by Kinsay; Robert Pirrie, attorney for Kinsay, presents invoice for goods and services from Kinsay to Layfield totaling  3581 lbs/tbco; mentions Thomas Miller, Richad Wharton; Court orders Kinsay to pay balance of 972 lbs/tbco.

 

40 ~  James Noble, cooper, Pltf. vs. William Millard, Deft. for a horse valued at 1200 lbs/tbco; Peter Dent, attorney for Noble, claims Millard had gained possession of the horse when it was loose and refused to return it to Noble; Samuel Alexander, attorney for Millard, denies claim; Jury called: William Bossman, Thomas Wilson, Alexander Thomas, Sam Long, Samuel Handy, Hope Tayler, John Outen, Tobias Pepper, John Johnson, Michael Holland, Miles Gray, Andrew Whittington; Jury finds for Millard; Pierce Bray assumes charges on behalf of Noble.

 

41 ~  Patrick Berry, Pltf. vs. Walter Tayler, sawyer, Deft. for 1200 lbs/tbco; Peter Dent, attorney for Berry, presents bill signed 7 June 1689 by Tayler, to be paid by following 10 October; witnesses Samuel Marchment, Mary Marchment; subsequently assigned to Edmund Allen of Accomac VA on 3 April 1690; witnesses Samuel Richardson, John Perkins; Samuel Alexander, for Tayler, claims it is not his deed; Court rules for Berry.

 

41 ~ Col. Cavid Browne, Pltf. vs. William Mead, Pltf. for 1207 lbs/tbco; Browne presents bond signed 23 April 1692 by Mead; witnesses Malkom Camroon, James Russell, Margaret Erskin; Meade admits debt; Court orders he pay with costs.

 

42 ~  James Weatherly, Pltf. vs. John Wheeler, Deft. for for 10,000 lbs/tbco; Peter Dent, attorney for Weatherly, presents indenture signed 15 April 1691 by Wheeler obliging himself to two years service, in consideration for release of Margaret Strawbridge, servant maid to Weatherly, from two years service; witnesses Robert Bowditch, Samp’n Power; Wheeler acknowledges debt of 2700 lbs/tbco to Weatherly; Court so orders, with costs.

 

43 ~  John Cole of Virginia, Pltf. vs. James Smothers, Deft.; note for payment of 300 lbs/tbco to Cole signed 3 March 1690/91 entered in record; witnesses Thomas Welbourne, Daniel of Thomas Jenifer; also note of James Smothers to pay 63 lbs/tbco dated 15 December 1690; witnesses William Martiall, John Glading; assigned by William Tayler to John Cole on 11 April 1693; Robert Pirrie assumes payment of debt and charges.

 

44 ~  John Webb, Pltf, vs. Lawrence Crawford, Deft., scieri facias for 505 lbs/tbco from judgement on 15 August 1691; Crawford does not appear; confirmed.
