117 ~  Court convenes; Commissioners present: Francis Jenckins, Thomas Dixon, Matthew Scarbrough, George Layfield, Thomas Newbold, James Round, John King.

117 ~  Maj. William Whittington, Pltf. vs. Peter Whaples, Deft; per judgement of 12 June 1695, 1631 lbs/pork attached of Whaples goods and chattels; Whittington accordingly made bond for double the amount for execution, pending grace period of one year and a day for Whaples to make good. (No action taken or explanation why this was entered in record.)

117 ~  James Round, Deft. vs. Robert Pirrie, Deft. for debt of 1743 lbs/tbco; Peter Dent, attorney for Round, claims debt is due as balance for merchandize provided 18 September 1694 at Pocomoke; Sam Worthington, for Pirrie, says Round owes Pirrie a greater amount; Court reviews accounts as presented and considers Round owes Pirrie 396½ lbs/tbco; rules a non-suit.

118 ~  Edward Day, Admn of Jane Walker, the Extr of Capt. Thomas Walker,  pltf. vs. Thomas Cox, carpenter, Pltf. for debt of 440 lbs/pork; Sam Worthington, attorney for Pltf., claims debt due for merchandize provided 6 May 1679; Peter Dent, for Cox, enters non assumpsit; Court judges the account not properly submitted; rules a non-suit.

119 ~  George Layfield & wife Elizabeth, Extrx of Col. William Stevens, Pltf. vs. Robert Howard, planter, Deft. for debt of 1663 lbs/tbco; Sam Worthington, attorney for Layfield, presents Howard’s account with Stevens from 1685-87 for merchandize and payment of tax; Peter Dent, for Howard, enters non assumpsit and presents supplemental account showing balance due of 1110 lbs/tbco; Court awards the latter balance to Layfield.

119 ~  Henry Schofield requests payment for 22 days attendance at Court; case of Layfield vs. Howard.

120 ~  Joseph Bassnet (Basnet), Pltf. vs. Hannah Maynard, Admx of James Maynard, Deft. for debt of 1000 lbs/tbco; Robert Pirrie, attorney for Basnet, presents bill of debt signed 21 March 1692/3 at Snow Hill, promising payment by 10 October following; witnesses William Willmott, William Seamore; Peter Dent, for Maynard, admits debt; Court orders payment, with costs.

120 ~  John Truett, Pltf, vs. John Poplewell, planter, Deft. for 12,000 lbs/tbco; Robert Pirrie, attorney for Truett, cites bond signed 2 March 1689 at Snow Hill (no specifics); Court considers the action not in its jurisdiction; rules a non-suit.

121 ~  Richard Wharton, Admn for estate of Francis Gunby, Pltf. vs. Thomas Gillett, Deft. for debt of 37 shillings; Peter Dent, attorney for Wharton, cites a noted signed 20 July 1692 at Pocomoke; Robert Pirrie, for Gillett, says the note is obliterated but Court finds sufficient basis to award for Wharton, as declared.

121 ~  Sr. Thomas Lawrence, Pltf. vs. Hannah Maynard, Deft; scieri facias for 2400 lbs/tbco awarded earlier; 1200 lbs having been paid, Court confirms for the remaining moiety.

121 ~  Capt. John King vs. John Tayler, Deft; attachment per earlier award now in possession of garnishee John Crouch; summoned by Subsheriff William Boseman, but does not appear; Court orders condemnation of 936½ lbs as awarded.

122 ~  Mr. Thomas Jones, Pltf. vs. William Clarke, Extr of Henry Bowman, Deft;  attachment per earlier award for 1000 lbs/tbco now in possession of garnishee John Goldsmith; summoned by Subsheriff William Boseman, but does not appear; Court orders condemnation as awarded.

122 ~  Mr. Francis Jenckins, Pltf. vs. Jacob Hill, Deft. for debt of 564½ lbs/tbco; Jenckins claims debt due from 1688 at Pocomoke per account he will present; Hill admits debt; Court orders payment.

122 ~  Mr. Francis Jenckins, Pltf. vs. Edward Gold, Deft. for debt of 333½ lbs/tbco; Jenckins claims debt due from 1688 at Pocomoke per account he will present; Gold admits debt; Court orders payment, with costs.

123 ~  William Cuming (Cumin), Pltf. vs. Robert Browne of Belfast Ireland, mariner, Deft. for £51/8/4 in back wages; Peter Dent, attorney for Browne, says that Browne hired with Cuming  as mariner for agreed rate of £2/10 per month on route from Belfast to the Island of Fyall to Virginia or Maryland and return to Ireland; Browne worked from 16 January 1694/5 to 3 October 1695, but Cuming has refused to pay him; Court considers the matter not within their jurisdiction; rules a non-suit.

123 ~  Mr. Francis Jenckins, Pltf. vs. John Vigerous, Deft; attachment per earlier award for 7394½ lbs/tbco, 200 lbs now in possession of garnishee Capt. William Coulbourne; summoned by Subsheriff William Boseman; no record of action.

124 ~  Rowland Jackson Pltf. vs. John Taylor of Wicomico, Deft. attachment per earlier award of 920½ lbs/tbco now in possession of garnishee John Crouch; summoned by Subsheriff William Boseman; Court orders condemnation as awarded.
