Ch. 219 LAWS OF MARYLAND

to issue certain classes of on sale a Special Theater (on-sale) beer, wine and
liquor licenses license for use in a theater under certain circumstances;
establishing the times for sale under the license; specifying certain fee and
transferability provisions; exempting the issuance of the license from certain
population quota provisions; and generally relating to theaters in Baltimore
County and alcoholic beverages licenses.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

30B.

(A) THE BALTIMORE COUNTY BOARD OF LICENSE COMMISSIONERS
MAY ISSUE A CLASS B SPECIAL THEATER (ON-SALE) BEER, WINE AND
LIQUOR LICENSE OR A CLASS B (ON SALE) BEER, WINE AND LIQUOR
LICENSE
FOR USE IN A THEATER IF THE THEATER:

(1) IS HOUSED WITHIN A BUILDING;

(2) HAS A CAPACITY TO HOLD A MINIMUM OF 1,500
PERMANENTLY INSTALLED SEATS; AND

(3) REGULARLY PRESENTS LIVE ENTERTAINMENT.

(B) NOTWITHSTANDING ANY OTHER PROVISION OF THIS ARTICLE
TO THE CONTRARY, A HOLDER IS AUTHORIZED TO SELL BEER, WINE
AND LIQUOR AT RETAIL FOR ON-PREMISES CONSUMPTION:

(1) FOR 2 HOURS BEFORE THE ENTERTAINMENT BEGINS;

(2) DURING THE ENTERTAINMENT; AND

(3) FOR 1 HOUR AFTER THE ENTERTAINMENT.

(C) THE ANNUAL LICENSE FEE IS $1,000.

(D) A SPECIAL THEATER (ON-SALE) BEER, WINE AND LIQUOR
LICENSE MAY NOT BE TRANSFERRED TO A LOCATION OTHER THAN THE
LOCATION OF ORIGINAL ISSUANCE.

(C) (E) THE BALTIMORE——COUNTY——POPULATION——QUOTA
PROVISIONS
POPULATION REQUIREMENTS OF THE RULES AND
REGULATIONS OF THE BALTIMORE COUNTY BOARD OF LICENSE
