AN ACT to repeal section one hundred and fifty-
|
|
|
nine and one-half of the Code of Public Local
|
|
|
Laws of the city of Baltimore, title "Costs," as
|
|
|
enacted by the act of January session of
|
|
|
eighteen hundred and seventy-four, chapter one
|
|
|
hundred and sixty-seven, and to amend and
|
|
|
re-enact same.
|

|
SECTION 1 . Be it enacted by the General Assembly
|
|
|
of Maryland, That section one hundred and fifty-
|
|
|
nine and one-half of article four of the Code of
|
|
|
Public Local Laws of the city of Baltimore, title
|
|
Repealed and
re-enacted.
|
" Costs," as enacted by an act of January session,
|
|
|
eighteen hundred and seventy-four, chapter one
|
|
|
hundred and sixty-seven, be and the same is
|
|
|
hereby repealed and re-enacted so as to read as
|
|
|
follows :
|
|
|
SECTION 159 1/2. That in all actions at law for
|
|
|
wrongs, independent of contracts, in any of the
|
|
|
courts of Baltimore city, where the verdict or
|
|
|
inquisition of damages after default made shall
|
|
|
be for a sum less than fifty dollars, the costs shall

be adjudged to tha defendant, unless the court

shall otherwise determine; but the court, before
|
|
|
allowing costs to the plaintiff in such case, shall
|
|
|
be satisfied that he had good reason for not bring-

ing suit before a justice of the peace; and in all

cases of appeals whatsoever from judgments of
|
|
|
justices of the peace in Baltimore city, costs shall
|
|
|
be allowed to plaintiff or defendant, in the dis-
