Maryland (1943 Supplement), title "Militia", sub-title ''Re-
employment of Persons in Military Service", be and it is
hereby repealed and re-enacted, with amendments, to read as
follows:
96.
(a) The rights and status of any such person who may
be absent in such military service shall be as follows in any
pension or retirement fund or system, including the Teachers
Retirement System of the State of Maryland: During the
period of such absence, no such person or his estate shall have
any right or be entitled to ordinary disability benefits, acciden-
tal disability benefits, death benefits, optional allowances or
other disability or death benefits in any such fund or system.
Any such person, during such absence except as herein
otherwise specified, shall retain his status and rights
as a member of any such pension or retirement fund
or system (a) if he does not withdraw any part of his
accumulated contributions, and (b) if within one year from
the time he is relieved from active duty or service he shall
again be actively employed by his employer or employing unit
at the time he left for active service, and (c) if he shall not
have previously taken any other employment. If under the
above restrictions any such person be again actively employed
by his said former employer or employing unit, within one
year from the time he is relieved from active duty, he shall
receive credit as membership service for the period of his
absence. During the period of such absence of any per-
son who was employed by the State or any agency
thereof, including teachers, at the time he entered active
service, the State or agency thereof shall make its con-
tribution on behalf of such employee as it would have
made had he not been absent and had retained his status
as an employee during the period of his absence and shall
also make on behalf of such employee the contribution which
such employee would have made had he not been absent and
had retained his status as an employee during the period of
his absence. Such person however, shall have no right to
withdraw any part of any such contribution made by the
State or any agency. The Boards, trustees or others charged
with the administration of any pension or retirement fund
or system are hereby authorized to issue rules and regulations
to carry out the provisions of this section, any present rules
and regulations to the contrary notwithstanding.
(b) The Boards, trustees or others charged with the ad-
ministration of any pension or retirement fund or system,
including the Teachers Retirement System of the State of
