Company, that it, the said Pennsylvania Railroad Company,
proposes to make said crossings, and specifying in said
notice whether the said crossing of the Potomac Wharf
Branch aforesaid, will be made at or above grade, and also,
at which of the points above named in said Branch, it proposes
to cross, and also stating the compensation which said Com-
pany is willing to pay for the easement of such crossings ; and
if said Cumberland and Pennsylvania Railroad Company
having been notified as aforesaid, shall refuse the terms of
or neglect to reply to said notification, and shall propose no
other arrangement upon which both parties shall agree,
then after the expiration of said ten days, and the failure to
agree as aforesaid, the said Pennsylvania Railroad Company,
in Maryland, shall have full power to condemn the easement
of such crossings, in the same mode, prescribed for the
condemnation of the land of individuals by the Act of
eighteen hundred and seventy-six, of the General Laws of
Maryland, Chapter two hundred and forty-two, Section
eleven.

"Sec. 3, And be it enacted, That said Pennsylvania Rail-
road Company shall have the right to cross the track or
tracks of the Baltimore and Ohio Railroad Company at one
point, either at grade or above grade ; and in the exercise of
such right shall be subject to all the conditions, limitations
and regulations provided in this Act for the crossing of the
Cumberland and Pennsylvania Railroad and the Potomac
Wharf Branch thereof, including the payment by said Penn-
sylvania Railroad Company of the cost of a signal station,
and the expense of keeping a watchman, at such crossing of
the Baltimore and Ohio Railroad.

"Sec. 4. And be it enacted, That if proceedings be taken to
condemn the easement of any of the crossings as provided
in this Act, the inquisition or inquisitions may be returned
to the Circuit Court of Allegany County, at any time during
the April Term of 1878, of said Court, and all proceedings
for the ratification or setting aside of such inquisition or in-
quisitions shall be had and determined at any time during
said term, but such inquisitions may be had thereafter and
returned to any subsequent term.

"Sec. 5. And be it enacted, That said Pennsylvania Rail-
road Company, in Maryland, is also hereby empowered to
make connection, by contract or agreement, with any other
railroad now, or hereafter to be constructed for the purpose
of reaching the City of Cumberland, or the Chesapeake and
Ohio Canal, and may agree with the owner or owners of any
wharf or wharves for the use of the same.
