-Gentlemen of the House of Delegates.
Inasmuch as this General Assembly is the Legisla-
ture which has been chosen next preceding the ex-
pination of time for which the Hon. Louis E. McComas
was elected Senator to represent this State in the Con-
gress of the United States; and inasmuch as Tuesday,
January 19th, 1904, will be the second Tuesday after
the meeting and organization of the Legislature at its
January session, 1904, we propose, with the concur-
rence of your Honorable Body, to proceed at the hour
of 12 o'clock, meridan, on that day to the election of
a Senator in the Congress of the United States, for
this State, for the term of six years, from March the
4th, 1905, to succeed the Hon. Louis E. McComas'
whose term will on the last mentioned date expire;
also that such election shall be conducted in the fol-
lowing manner as prescribed by chapter 1, of title 2 of
the revised statutes of the United States, in such
case made and provided, to-wit: The Senate and
House of Delegates shall each in their respective
chambers, openly, at the time aforesaid by a
viva voce vote by each member present, name one
person for such Senator, and the name of the person
so voted for, who receives a majority of the whole
number of votes cast in each house, shall be entered
on the Journal of that house by the clerk or secretary
Thereof, or if either house fails to give such majority
to any person on that day, the fact shall be entered
on the Journal of such house, also at 12 o'clock, meri-
dian, on Wednesday, January 20th, 1904, the mem-
bers of the Senate and the members of the House of
Delegates shall convene in joint assembly in the hall
of the House of Delegates, and that the Speaker of the
House of Delegates shall be chairman of such joint
assembly, and that the Journal of each house shall
then be read, and if the same person has received a
majority of all votes in each house he shall be declared
duly elected Senator of the United States, but if the
same person has not received a majority of the votes
in each house, or if either house has failed to take pro-
