general election for members of the city council, after twenty
days' public notice, by handbills or otherwise, in their discretion,
or at a special election, to be ordered by the said mayor and
city council, to be held under an ordinance for such purpose,
made and passed after twenty days' public notice thereof as
above provided, stating specifically the object of such election
and provided, a majority of the legal voters voting thereat assent
to the same; but in case any real property shall hereafter revert
to said mayor and city council by reason of the failure of com-
pliance with the terms of any deed or contract now in existence,
such real estate shall not be sold, but shall be held for the bene-
fit of said city, said mayor and city council having the right to
lease the same to manufacturers or other industrial enterprises.

46. The said mayor and city council shall, as soon as prac-
ticable, provide by ordinance for a survey and map of the limits
of said city, (which limits shall remain as located by the last
survey made thereof under the authority of said mayor and city
council, ) and for the location upon said map of the streets and
alleys already laid out and opened; and the map thus executed
under said ordinance shall be recorded in the office of the clerk
of the circuit court for Allegany county, and said map, or a cer-
tified copy thereof, shall be prima facie evidence of the contents
thereof in any suit or suits, action or actions in any court of law
or equity in this State.

47. The property and funds of every kind belonging to or in
possession of said city are vested in said corporation; and said
corporation may receive in trust and control for the purposes,
thereof, all money or other property which may have been or
shall be bestowed on such corporation by will, deed, gift or con-
veyance, in trust for the general corporation purposes, or in aid
of the indigent poor, or for the general purposes of education, or
for charitable purposes of any description within the city.

48. The city of Cumberland shall be divided into six wards,
bounded as follows, viz: for the first ward, all that portion of the;
