PHILLIPS LEE GOLDSBOROUGH, ESQ., GOVERNOR. 787

entitled "An Act to repeal Article 6, sections 116 to 134,
inclusive, of the Code of Public Local Laws, title 'Caroline
County,' sub-title 'Federalsburg,' and also Chapter 293 of the
Acts of 1894," be and the same is hereby repealed and re-en-
acted so as to read as follows:

SEC. 26. And be it enacted, That the said commissioners
may pass such by-laws and ordinances as they shall deem neces-
sary and for the good government of said town and the inhabi-
tants thereof; also for the prevention, removal or abatement of
nuisances; to prevent swine, geese and other fowls and animals
or stock from going at large; for controlling the erection and
location of buildings, fences, stock enclosures, and for prohibit-
ing and controlling the use of powder, firearms, firecrackers
and other explosives; for the protection of public property,
sidewalks, shade or ornamental trees from destruction and
injury; for the paving of sidewalks and assessing and taxing
the expenses thereof in whole or in part upon the respective
owners of property fronting thereon; for & license or tax on
public exhibitions or amusements of all kinds, billiard, pool or
"bagatelle tables, and ten pin alleys, and for the collection of
the same; for a tax on persons for each dog kept by them, and
to cause any dog to be killed; for the promotion of morality,
nealth, convenience and safety of the inhabitants of said town,
and for the locating, opening, constructing, straightening, widen-
ing, extending, improving, grading, paving, repairing, closing
or sewering of streets, lanes and alleys of said town, whether
done exclusively by said commissioners, or in conjunction with,
or under the supervision of, the State Roads Commission; and
all damages done and all benefits received by the locating, open-
ing, constructing, straightening, widening, extending, improv-
ing, draining, paving, repairing, closing, or sewering of said
streets, lanes or alleys shall be determined and assessed by
three disinterested persons, residents of said town, to be
appointed by said commissioners, who shall, within a reason-
able time after notification of their appointment, take an oath
"before a justice of the peace for Caroline county, that they
will faithfully, fairly and impartially, without prejudice, value
and assess in money the loss or damage to be suffered and
incurred, as well as benefits to be received, by any person inter-
ested in property, over, through and near the said street, lane
or alley to be located, opened, constructed, straightened,
widened, extended, improved, drained, paved, repaired, closed
or sewered, and they shall return the same in writing under
their hands and seals, with a certificate of their qualification,
before a justice of the peace, as hereinbefore provided, to the
