whatsoever upon any person or persons, body corporate or
bodies corporate owning any property within the limits of said
town, who may be absent therefrom or a non-resident thereof
or upon which, or their proper representative or representatives
in the case of corporations, personal service cannot be had for
any other reason, and the marshal make return to that effect,
service of notice or process may be made by publication of
said notice or process once a week for three successive weeks
in the official journal of the town or in some newspaper pub-
lished in Montgomery county, which said notice or process by
publication shall be as good and effectual as personal service;
provided, a copy or copies of the same be mailed to the last
known address, if any, of such person or persons, body cor-
porate or bodies corporate, and affidavit be made of such mailing
or to the effect that there is no such known address.

561. That those parts of the several county roads within
the limits of said town are hereby made and declared to be
public streets or avenues of said town, and shall be from time
to time improved and repaired as -in the discretion of the coun-
cil the public interest may require, and the resources of the
town may justify.

562. That the commissioners of the county, the board of
public school commissioners, justices of the peace, sheriffs, con-
stables and all other State and county officers shall have, hold
and exercise their offices in said town as heretofore, except- as
qualified by the other sections of this act. The County Commis-
sioners of Montgomery County shall, on or before the first day
of January, 1907, and on or before the first day of January
in each and every year thereafter, pay over to the town of
Somerset that proportion of the entire county levy for the
entire roads which the total real property assessed within the
limits of the town of Somerset shall bear to the whole amount
of assessed real property in Montgomery county, so that the
town of Somerset shall receive and disburse for the mainten-
ance of the streets of said town the amount levied for the repair
of roads by the said County Commissioners of Montgomery'
County, upon the real property within the corporate limits of
the town of Somerset.

563. That this act is hereby declared to be a public act, and
may be used in evidence in all the courts of this State without
proof.
