SEC. 5. And be it further enacted, That the said County
Commissioners be and they are hereby authorized, empowered
and directed to apply the proceeds of the bond issue, of nine
thousand dollars so sold as aforesaid, and the sum of one thou-
sand dollars to be donated as aforesaid, to the payment for
building, improving and relocating of the public road between
the corporate limits of the town of Kensington and the corporate
limits of the town of Garrett Park and thence from the cor-
porate limits of said town on the west to the Rockville and
Georgetown turnpike within the seventh, fourth and thirteenth
election districts of said county; and the said County Commis-
sioners be and they are further authorized, empowered and
directed to apply the proceeds of the bond issue of three thou-
sand dollars, so sold as aforesaid, and the sum of one thousand
to be donated as aforesaid, to the payment for the improving:
of the public road from Forest Glen to the said Washington
and Brookville Turnpike, in the thirteenth election district of
said county; all building and improving thereof to consist of
the grading of the said road or roads and the construction
thereon of a macadam road bed, according to the plans and
specifications prepared by the Road Superintendent of Mont-
gomery county, State of Maryland.
SEC. 6. And be it further enacted, That the said County
Commissioners are hereby authorized and empowered, in their
discretion to relocate the road bed of the public highway from
the corporate limits of the town of Kensington to the corporate
limits of the town of Garrett Park from the northern side of
the Metropolitan Branch of the Baltimore and Ohio Railroad,
as now, to the south side thereof.
SEC. 7. And be it further enacted, That failure to make to
the said County Commissioners the donation of one thousand
dollars for the improving of one of the said roads, as herein-
before provided, shall not effect a compliance with the pro-
visions of this act having relation to the improving of the other
of said roads.
SEC. 8. And be it further enacted, That this act shall take
effect from the date of its passage.
