And the Said George Plowden in mercy etc.
William Stone plantiffe: George Plowden Defendant.
Prince Georges County Ss. George Plowden late of Prince Georges County
otherwise Called George Plowden of Calvert County in the province of Maryland
Gentleman was Sumoned to Answer unto William Stone of a plea that he
Render unto him the full and Just Sume of one thowsand pounds of good
Sound Marchantable leafe tobaccoe and Caske which to him he oweth and
unjustly Deteyneth etc.
And whereupon the Said William Stone in his proper person Saith that the
Said George the 18th day of Aprill in the yeare of our Lord 1695 at Charles
Towne within the Jurisdiction of this Court by his Sertaine bill Obligatory
which the Said William with the Scale of the Said George Signed bringeth here
into Court the date whereof is the day and yeare aforesaid Acknowledged him-
selfe to be bound unto the Said William in the Said full and Just Sume of one
thowsand pounds of good Sound Marchantable Leafe tobaccoe and Caske to be
paid to the Said William Convenient in Calvert County Att or upon the tenth
day of October next Ensueing the date of the Said bill to the which payment
[246] Well and truly to be made and done the Said George bound himselfe
firmly by the Said Bill Nevertheless the Said George the Said Sume of 1000 lbs.
of tobaccoe and Caske Although often Required the Same to the Said William
hath not Rendered but hath hitherto Refused and Still doth Refuse to the
Dammage of the Said William of 2000 pounds of tobaccoe and thereof he
bringeth his Suite etc.
Pledges etc. John Doe, Richard Roe. William Stone.
And the Said George Plowden by John Meriton his Attorney Cometh and
defendeth the force and Injury when etc. and prayeth Leave thereof to Imparle
here untill the next Court and it is granted unto him the Same day is given to
the plantiffe Likewise.
And now here at this day (to witt) the 28th day of September Annoque
Domini 1697: Came here as well the Said William Stone in his proper person
as the Said George Plowden by his Attorney aforesaid and the Said William
Stone prayeth that the Said George Plowden to his Decleration aforesaid may
Answer etc.
Whereupon the Said George Plowden by his Attorney aforesaid Cometh and
defendeth the force and Injury when etc. And Craveth Oyer of the bill Obliga-
tory in the plantiffes Decleration mentioned etc. And it is Shewed unto him etc.
And the Said Defendant by his Attorney aforesaid further Cometh and defendeth
the force and Injury when etc. And Saith that he is not Informed by the Said
George Plowden his Clyant of any Answer for the Said George Plowden in the
plea aforesaid to bee given And nothing more thereof Saith by which the Said
William Stone Remaineth against the Said George Plowden thereof undefended
etc.
Therefore it is Considered that the Said William Stone Recover against the
Said George Plowden the Sume of one thowsand pounds of tobaccoe his Debt
aforesaid And his Damages by Occation of Deteyning the Said Debt two hundred
fifty Six pounds of tobaccoe to the Said William Stone of his Assent by the Court
here Adjudged etc. And the Said George Plowden in mercy etc.
