denye to the Damage of the Said Thomas of one thowsand pounds of tobaccoe
and thereupon he brings this Suite etc.

To one yeares Rent of a plantation belonging to me Hired to you as by
agreement ........................................................... 500
And the Said John in his proper person Cometh and Defendeth the force And
Injury when etc. and Saith that he Cannot gainsay the Action of the Said
Thomas Hollyday nor but that he oweth to the Said Thomas Hollyday the Said
Sume of five hundred pounds of tobaccoe in manner and forme as the Said
Thomas Hollyday in his decleration aforesaid against the Said John Tayler
hath Declared etc.
Therefore it is Considered that the Said Thomas Hollyday Recover against
the Said John Tayler as well the aforesaid Sume of five hundred pounds of
tobaccoe for his Damages in the premises aforesaid which he hath Sustained by
Occation of the Nonperformance of the promise and Assumption of the Said
John Tayler to the Said Thomas Hollyday Lately made as alsoe the Sume of
two hundred and fourteene pounds of tobaccoe for his Costs and Charges in this
behalfe Sustained to the Said Thomas Hollyday of his Assent by the Court
here Adjudged etc. and the Said John Taylor in mercy etc.

The plantiffe by William Stone his Attorney Sues the Defendant in a plea of
trespass upon the Case And the Defendant in Open Court in his owne person
Confesed Judgment to the Same And William Ludell in open Court became
Security for the Same for the Defendant as by Docquett book Appeareth but
there is not any Decleration or Account filed for the Same by the plantiffs
Attorney.

and Levyed here his plaint against John Garrett late of Prince Georges County
Gentleman of a plea of trespass upon the Case etc. And prayeth Spetiall baile
to the Same.
And hereupon Came into Court Major William Barton in his proper person
and undertook for the Said John Garrett that if it Should happen the Said John
Garret in the plea aforesaid to be in any manner lawfully Convicted then he
the Said William Barton doe grant for himselfe all Such Damages and Costs
to the Said Charles Tracy in any manner by the Court here to be Adjudged
to be made and Leavyed on his goods and Chatties Lands and tenements to the
use of the Said plantiffe if it Should happen the Said Defendant pay not the
Damages and Costs aforesaid nor Render his body to the Custody of the Sheriffe
for the Same there to Remaine untill etc.
