CHAP. 114.

                                LAWS OF MARYLAND.

such meeting, whatever number of shares he, she or they, may be
entitled to notwithstanding, and that each persons be entitled to one
vote for every share so held under the number of twenty-five.

Stockholders incorporated.     4.  AND BE IT ENACTED, That the stockholders in said company
shall be and are hereby declared a body politic, by the name of The
President and Managers of the Loveton Turnpike Road Company,
and by the name the subscribers, and their successors, shall
have succession during the continuance of this incorporation, and
shall have all the privileges and franchises of and incident to a
corporation, and shall be capable of taking and holding the said
capital stock, and the increase and profits thereof, and of enlarging
the same from time to time by new subscriptions, on the original
term, in such manner and form as they shall be found necessary to
fulfil the intent of this act; and of purchasing and taking to them,
and their successors, in fee simple, and for any lesser estate, all
such lands, tenements, hereditaments and estate, real and personal,
as shall be necessary to them in the prosecution of their works;
provided, the said real estate shall not exceed twenty acres in any
one lot or parcel; and of suing and being sued, answer and being
answered, and shall have power to make a seal, and alter and
break and renew the same, according to their will and pleasure.

    5.  AND BE IT ENACTED, That said company shall be, and are
hereby invested and clothed with all the privileges, rights, immunities
and advantages, which are held and possessed by the turnpike
company incorporated by an act passed at November session
eighteen hundred and four, * entitled, An act to incorporate companies
to make several turnpike roads through Baltimore county,
and for other purposes, and to be governed by the same regulations
as are therein prescribed, and be entitled to the same tolls; and
every clause and provision of said act, relative to the road therein
contemplated, so far as the same are applicable and not inconsistent
with this act.
Bodies politic may
be stockholders.
    6.  AND BE IT ENACTED, That it shall be lawful for any incorporation
or body politic in the United States to become stockholders
in said company.
Road not being
completed in ten
years, rights to revert
to state.
    7.  AND BE IT ENACTED, That if said company do not proceed
to carry on said work within two years after passing of this act,
or shall not within ten years thereafter complete the said road, it
shall be lawful for the legislature of this state to resume the
rights, privileges, liberties and franchises, granted by this act to
said company.
Damages to be estimated.     8.  AND BE IT ENACTED, That in each of the counties of Baltimore
and Harford, the county court shall appoint five commissioners,
who shall estimate the amount of damages sustained by any
person or persons by reason of said road passing through his, her
or their land, or by taking stone, gravel or other materials, for
the use of said road, in cases where the parties cannot agree,
which estimate shall be final in determining such damages.
State may take
possession of road.
    9.  AND BE IT ENACTED, That if the legislature of Maryland
shall at any time after the year eighteen hundred and fifty-one,
think proper to take possession of said road for the purpose of declaring
it a free road, six persons shall be appointed by the governor
of this state, and six by said company, who, or any seven of
